Proposed hlterim Connection for EmX Bus Route- St. Joseph Place to Baldy View Lane

Q1. L TD proposed use of swales with infiltration for stormwater. Is this satisfactory to the City?
Has the City ever considered use of bio-slopes (ODOT BMP) for stormwater treatment and if so
would that be an acceptable BMP application here? When infiltrating the water, other than DEQ
injection well registration, what other permits would be required (i.e. drinking water protection,
" landldrainage alteration permit)?

" Q2. The project is within the McKenzie River floodplain. Previous floodplain analysis by Peace
Health indicates very little impact to the McKenzie River as a result of full buildout of the
campus or even the urban growth boundary to current zoning standards. It is assumed
construction of the roadway and associated stormwater facilities would not be considered an
impact to the floodplain. Would the City require a Floodplain Overlay development" permit
application, given that the proposal would not affect flood flows or the capacity of the
floodplain? Please confirm.
A: The City will not require a Floodplain Overlay District (FPO) application for the project. However, in
accordance with SDC 3.3-420.5, the proposed street construction must provide for full accessibility
during a 100 year flood and the surface of the street cannot be more than 1 foot below the base
flood elevation (BFE). The road also should not be elevated such that it creates an impediment to
possible flood flows. Construction plans shall include the calculated base flood elevation and
proposed street surface elevations to demonstrate conformity. The 2003 McKenzie River
Floodplain Assessment by David Evans & Associates should be used as the baseline for calculating
flood elevations in this area, unless more contemporary data is available.
Q3. Baldy View Lane, in places is failing or failed. L TD plans to remediate the roadway for ride
comfort of the EmX vehicle with a 2" overlay, but does not plan to structurally reinforce the
roadway. Depending on the duration of EmX on this route it is possible the buses could further
damage the structure of the road. L TD proposes to evaluate the road after it is no longer used
for EmX service and rehabilitate at that time if required by the City. Is this proposal acceptable
and what agreements, if any, need to be prepared between the agencies? Note a similar
agreement will be reached between L TD and Peace Health for impacts to St. Joseph Place east
of Riverbend Drive.

Q4. We understand that an amendment to the approved RiverBend MasterPlan is not required to
accommodate the interim improvements proposed. Are there any other permits, land use
approvals, or processes needed to accommodate this project (e.g. Public Improvement Plans),
and if so, what specifically are the processes, costs and timelines that would be required?
A: There are no anticipated land use approvals required for the interim road.connection. However, the
applicant will need to demonstrate" that the road connection can be accommodated within existing
rights-of-way or dedicated easements. Work that is being done within the public right-of-way will
"require an approved PIP and Land Drainage Alteration Permit (LDAP), etc. PW Engineering andlor
