, AN ORDINANCE AMENDING SECTIONS 8-6-15, 8-6-16, 8-6-17 AND 8-6-18, ARTICLE 6,
CHAPTER VIII OF THE SPRINGFIELD CODE PERTAINING TO THE OPERATION OF SHOOTING RANGES.
WHEREAS, the Springfield City Council has declared its intention to allow
private individuals as well as public agencies to operate shooting ranges; and
WHEREAS, lawful notice of the public hearing for this request was published;
and
WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth
Street, on Monday, the 1st day of February, 1993, at the hour of 7:30 p.m., to hear
this request;
NOW, THEREFORE, THE,CITY COUNCIL DOES ORDAIN:
SECTION 1. Section 8-6-15, Article 6, Chapter VIII of the Springfield Code
pertaining to the operation of shooting ranges is hereby amended as follows:
"8-6-15 Shooting Ranges--General. It shall be unlawful to establish,
maintain, or operate any shooting range within the city unless a
business license for that use is obtained from the city. Every place or
building where rifles or pistols which fire live ammunition are used for
shooting at targets, whether for hire or not, shall be deemed a shooting range
under the provisions of this section."
SECTION 2. Section 8-6-16, Article 6, Chapter VIII of the Springfield Code
pertaining to the operation of shooting ranges is hereby amended as follows:

"8-6-16 Shooting Ranges--Business License. An applicant for a shooting
range business license shall apply to the Development Services
Department prior to opening a shooting range facility. The following
conditions of operation shall apply to the issuance of the shooting range
business license:
(1) Operators and employees shall have no convictions which would prohibit
them from obtaining a Federal firearms dealer'S license and they shall
have no felony convictions within the past 5 years or no-crass A
misdemeanor convictions within the past 3 years;

Hours of operation of the shooting range shall be limited to the
following times: 10:00 a.m. to 10:00 p.m., Monday through Saturday and
noon to 10:00 p.m. on Sunday;
(3)
Site Plan Review procedures of Article 31 and any other applicable
standards specified in the Springfield Development Code shall be met;
(4)
Buildings shall designed for the heaviest ammunition that might be used
on the range as specified in the "Range Manual" prepared by the National
Rifle Association and/or "Model Range Code for Gallery Shooting Ranges"
prepared by Caswell International Corporation or other similar document
as may be approved by the Building Official and the Fire Marshall.
Special attention shall be given to ventilation systems, lighting, safety
baffles and backstop configuration. The following conditions of
operation shall apply:

a)
Armor piercing and incendiary ammunition is prohibited;

b)
Operation of the shooting range shall cause not more than 40 db of
noise at the outside building wall (as determined by a qualified
acoustical consultant prior to construction); and,
c) The storage of gunpowder, ammunition and primers shall be in
accordance with the Uniform Fire Code.
d) The operator shall ensure that all rifles and pistols are inspected
to determine that the weapons are unloaded prior to leaving the
firing area.
(5) Compliance with the conditions specified in Subsection (4) shall be
determined by the Building Official and Fire Marshall from plans provided
for construction and Site Plan Review prior to obtaining the building
permit. Upon compliance, issuance of the business license will occur at
the time of building permit issuance.
(6) The shooting range business license fee shall be $100.00. The license
shall be granted for a period of one year and shall be renewed on a yearly
basis."
SECTION 3. Section 8-6-17, Article 6, Chapter VIII of the Springfield Code
pertaining to the operation of shooting ranges is hereby amended as follows:

"8-6-17 Shooting Ranges--Business License--Revocation. Any shooting range
business license shall be subject to revocation by city staff,
including, but not limited 'to police, fire, building safety or code
enforcement, if the shooting range is found to be in violation of the
conditions under which the business license was issued. The revocation
decision may be appealed to the city council. The city council reserves the
right, in its discretion, to uphold the revocation or refuse to allow future
shooting range business licenses to be issued until the council is satisfied
that the conditions specified in Section 8-6-16 have been met."
SECTION 4. Section 8-6-18, Article 6, Chapter VIII of the Springfield Code
pertaining to the operation of shooting ranges is hereby amended as follows:
