HomeMy WebLinkAboutOrdinance 5665 12/07/1992 ',.r ,# ."-,, ~ v" ~'. ~ ...... . . . ~ ,0 ATTACHMENT A ORDINANCE NO. 5665 (GENERAL) AN ORDINANCE REGARDING THE SITING OF MANUFACTURED HOMES IN THE CITY OF SPRINGFIELD AND ITS URBANIZABLE AREA:AMENDING SUBSECTION (4) (d) OF SECTION 36.010 "RESIDENTIAL DISTRICTS-GENERAL" AND SUBSECTION (1) OF SECTION 36.050 "PARKS AND SUBDIVISIONS-GENERIC STANDARDS" OF ARTICLE 36 "MANUFACTURED DWELLING STANDARDS" OF THE SPRINGFIELD DEVELOPMENT CODE, AND DECLARING AN EMERGENCY. WHEREAS, Ordinance 5591 (General) amending Subsection (4) (d) of section 36.010 "Residential Districts-General" of Article 36 "Manufactured Dwelling Standards" of the Springfield Development Code provides that manufactured dwellings shall not be permitted on land with an average slope exceeding 10 percent, and WHEREAS, Ordinance 5601 (General) amending Subsection (1) of Section 36.050 "Parks and Subdivision-Generic Standards" of section 36 Mobile Home Standards of the Springfield Development Code provide that new manufactured homes subdivisions and manufactured dwelling parks shall be located on land with an average slope of less than 10 percent, and WHEREAS, Section 3 of Ordinance 5601 makes specific reference to maps "identifying eligible and ineligible sites on display during the public hearing process identifying sites which were eligible or not eligible for manufactured dwellings", and WHEREAS, those sites with average slopes "exceeding 10 percent" were not identified or depicted as eligible for manufactured dwellings, and WHEREAS, further research, refinement, review and identification has determined that lots and parcels may have been incorrectly identified as having an average slope greater than 10 percent or incorrectly identified as having an average slope of 10 percent or less, and WHEREAS, the availability of such land for manufactured housing should be based upon the best available information demonstrating the actual average slope. NOW THEREFORE section 36.010(4) (d) and section 36.050(1) are hereby amended as follows: section 1. Section 36.010(4) (d) is hereby amended as follows: "(d) Notwithstanding Subsections (1)-(3) of this Section, manufactured dwellings shall not be permitted on land with an average slope exceeding 10 percent. The determination of the average slope shall be based upon the best available information satisfactory to City demonstrating the average slope at the time of the development application. II Section 2. Subsection (1) of section 36.050 is hereby amended as follows: . "(1) New manufactured home subdivisions and manufactured dwelling parks shall be located on land with an average slope 10 percent or less. Areas with average slopes exceeding 10 percent shall be retained as open space. Manufactured dwelling parks shall enclose a minimum development area of 3 acres. The determination of the average slope shall be based upon the best available information satisfactory to City demonstrating the average slope at the time of the development application. The vacation, re-platting, recontouring or other reconfig- uration of land for the siting of manufactured homes, excluding those units constructed to the Structural Specialty Codes and Fire and Life Safety Codes adopted by the city of springfield, shall not remove the siting prohibition set forth in this subsection." section 3. It is hereby found that matters regarding the siting of manufactured homes in the City limits of the City of Springfield, as set forth in sections 1 and 2 above, are matters affecting the public health, safety and welfare and that an emergency exists and that this ordinance shall therefore take effect immediately upon its passage by the City Council and approval by the Mayor. ADOPTED by the Common Council of the City of Springfield by a vote of 6 in favor and 0 against this 7~~ of December , 1992.
