HomeMy WebLinkAboutOrdinance 5664 11/16/1992 . . . ORDINANCE NO. 5664 AN ORDINANCE CONCERNING THE AIR QUALITY OF THE CIT~ AMENDING THE ENFORCEMENT PROCESS, AND DECLARING AN EMERGENCY. The City Council of the City of springfield finds that: (A) The Lane Regional Air Pollution Authority is authorized and designated to enforce and administer sections 4-8-4(2) through 4-8-4(5) of Article 8 of Chapter IV of the Springfield Code; and (B) The Lane Regional Air Pollution Authority, LRAPA has adopted new administrative and hearing procedures with the goal of resolving disputed cases as inexpensively, quickly, and conveniently as possible, while at the same time providing appropriate due process for those who may be issued notices of violation with civil penalties; NOW THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1. Section 4-8-4(4) of Article 8 of Chapter IV of the Springfield Code is hereby amended as follows: (4) ENFORCEMENT. LRAPA is hereby authorized and designated to enforce and administer the process of section 4-8-4(2) through 4-8-4(5) of the Springfield Code in accordance with the adopted administrative and hearing procedures of LRAPA set forth in its rules and regulations adopted November 10, 1992. section 2. It is hereby found and determined that matters concerning the air quality of the City of Springfield, and the enforcement for violation thereof are matters affecting the welfare of the city of Springfield, and that an emergency is therefore found and declared to exist, and this ordinance shall therefore take effect immediately upon its passage by the Council and approval by the Mayor.
