HomeMy WebLinkAboutOrdinance 5662 11/02/1992 . . . ,f, <~ ORDINANCE NO. 5662 AN ORDINANCE AMENDING CITY CODE SECTIONS 5-4-2, 5-4-8, AND 5-4-13 OF ARTICLE 4 OF CHAPTER V OF THE SPRINGFIELD CODE PERTAINING TO THE CONTROL OF DOGS AND OTHER ANIMALS IN THE CITY OF SPRINGFIELD, LANE COUNTY, OREGON. THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: SECTION 1. section 5-4-2 "Definitions", Subsection (2) "Adult Animal" (b) of Article 4 of Chapter V of the Springfield Code is hereby amended as follows: "(b) Any horse, cow, miniature horse, or pygmy one (1) year." llama, sheep, goat, goat over the age of SECTION 2. SECTION 5-4-2 "Definitions" Subsection (9) "Dog" of Article 4 of Chapter V of the springfield Code is hereby amended as follows: "(9) A highly variable, carnivorous, domesticated mammal, probably derived from several wild species. The term dog does not include wolf or wolf mix. The term dog includes male or female, of any age, size, color, or breed. with the exception of sections 5-4-3, 5-4-13(2), 5-4-28, 5-4-29, and 5-4-33, police service dogs or K-9 dogs actively employed by a police agency are exempt from the provisions of Article 4." SECTION 3. section 5-4-2 "Definitions", Subsection (12) "Exotic Animals" (c) of Article 4 of Chapter V of the Springfield Code is hereby amended as follows: "(c) Any wolf, or wolf mix, or any canine not indigenous to Oregon, except the species Canis familiaris (domestic dog); and" SECTION 4. section 5-4-2 "Definitions" Subsection (13) "Farm Animal" of of Article 4 Chapter V of the Springfield Code is hereby amended as follows: "(13) Farm animal. Poultry and fowl (domestic birds commonly raised for meat or eggs, such as chickens, ducks, geese or turkeys), rabbits, bees, horses, cows, llamas, sheep, goats, miniature horses, and pygmy goats." SECTION 5. section 5-4-2 "Definitions", Subsections (15) Leash, (16) Livestock, (17) Neutered Dog (18) Keeper, (19) Owner, (20) Vicious Dog, (21) Watchdog, and (22) wildlife, of Article 4 of Chapter V of the Springfield Code are hereby renumbered respectively as Subsections (17 through 24). SECTION 6. section 5-4-2 "Definitions" Subsection (18) "Livestock" as renumbered by Section 5 above, of Article 4 of Chapter V of the Springfield Code is hereby amended as follows: "(16) Livestock. Cattle, sheep, horses, miniature horses, goats, pygmy goats, swine, fowl, poultry and any furbearing animal bred are maintained commercially or otherwise on property within pens, cages, and hutches. SECTION 7. section 5-4-2 "Definitions" of Article 4 of Chapter V of the Springfield Code is hereby amended by addition of the following Subsections (15) and (16) definitions: "(15) PVqmV Goat. A genetically small, cobby, and compact goat whose body circumference in relation to height and weight is proportionately greater than other breeds of goats; having a maximum height of not to exceed 23 inches for a Doe (female), 24 inches for a Buck (unneutered male), and 27 inches for a Wether (neutered male), with measurement taken at the highest part of the back at the base of the neck where the shoulder blades almost touch." "(16) Miniature Horse. A horse not to exceed 34 inches in height measured at the last hairs of the mane at the base of the neck." SECTION 8. section 5-4-2 "Definitions" of Article 4 Chapter V of the Springfield Code is hereby amended by addition of the following Subsection (25) definition: "(25) Wolf or Wolf Mix. Wolf or any dog breed which has been mixed or bred with wolves within the last three generations. SECTION 9. section 5-4-8 "Lot Size and Numbers of Farm Animals--Horses, Cows, Llamas, Sheep and Goats." of Article 4 of Chapter V of the Springfield Code is hereby amended as follows: Lot Size and Numbers of Farm Animals--Horses. Cows. Llamas. Sheep Goats. Miniature Horses. and Pyqmy Goats" (1) The keeping of horses, cows, llamas, sheep and goats shall be limited to the following: # of Adult Animals Minimum Lot Size 1 2 or more 20,000 square feet +20,000 square feet/each animal (la) The keeping of miniature horses and pygmy goats. shall be limited to the following: # of Adult Animals Minimum Lot Size Not to exceed 2 20,000 square feet Ordinance No. 5662 Page 3 . ,. . 3 or more +10,000 square feet/each animal (2) The number of permitted young shall be limited to two (2) times the number of permitted adult animals. (3) At least 75 percent of the lot area shall be accessible to the animal(s) without violation to the required yard setbacks. SECTION 10. section 5-4-13 "Sanitation" Subsection (2) of Article 4 of Chapter V of the Springfield Code is hereby amended as follows: "(2) All structures designed to house farm animals and farm animal pens and runs shall be located in the rear portion of the yard no closer than forty (40) feet from the front property line or twenty (20) feet from any interior property lines." Adopted by the Common Council of the City of Springfield this 2nd day of November , 1992 by a vote of 6 for and 0 against.
