ORDINANCE NO. 5657 ~ AN ORDINANCE CONCERNING PUBLIC SAFETY, PROHIBITING SKATEBOARD OPERATION OR RIDING WITHIN CERTAIN SPECIFIED AREA, ADDING SECTION 5-11-11 "SKATEBOARD OPERATION OR RIDING" TO SPRINGFIELD CODE. Section 1. The Springfield Code is hereby amended by the addition of a new Section, 5-11-11 to Article XI, Chapter V "Offenses" as follows: 5-11-11 Prohibition of Skateboard Operation or Riding within Certain Specified Area. (1) Due to the present density and volume of pedestrian and vehicle traffic within the area specified in this Section, skateboard operation or riding presents a danger to pedestrians and motorists as well as skateboard operators or riders. Further, the operation or riding of skateboards damages wood and concrete surfaces on public and private improvements, decreases the useful life of such public and private improvements, and increases the maintenance cost of such improvements. . (2) A skateboard is defined as a board material, natural or synthetic, with affixed to the underside, designed to be by a person and propelled by human power. of any wheels ridden (3) It shall be unlawful for any person to operate or ride a skateboard within the rectangular area bounded by the west sidewalk adjacent to North 7th Street, the South sidewalk adjacent to B Street, and the East sidewalk adjacent to North 5th Street, and the North sidewalk adjacent to Main Street. . (4) City police officers may issue a citation for a violation of Section 5-11-11 of this code. Except as may be specified in Subsection (5) any person found to be in violation of this Subsection (4) shall be subject to a $50.00 fine. (5) If a willful violation of Section 5-11-11 occurs, a citation may be issued by the officer. A willful violation shall be a violation which occurs within 12 months of a previous violation. Any person found to have committed a willful violation as specified in this Subsection (5) shall be subject to a $100.00 fine. (6) Nothing in these regulations shall prohibit the service of complaints by police officers. In the event a violator is arrested or issued a citation in lieu of custody by a police officer, his or her report shall be promptly ORDINANCE NO. 5657 . Page 2 . forwarded to the City Prosecutor for a determination as to issuance of the complaint. (7) After a complaint has been filed and served on the defendant, all subsequent proceedings shall be in accordance with the rules and procedures of the Municipal Court or the Lane County Juvenile Court, as appropriate. (8) Persons 18 years of age and older will be cited to the Springfield Municipal Court. Persons who have not yet attained the age of 18 years will be referred to the Lane County Juvenile Court. (9) In addition to the fines specified, in Subsections (4) and (5), any person found to be in violation of this Section shall also be subject to an assessment of an amount equal to the cost to repair the damages, if any, caused by such skateboard operation or riding.
