HomeMy WebLinkAboutOrdinance 5622 03/16/1992 . . . ... # r ORDINANCE NO. 5622 (SPECIAL) AN ORDINANCE CALLING FOR A SPECIAL ELECTION FOR SUBMITTING TO THE ELECTORS OF THE CITY OF SPRINGFIELD, OREGON, AT A SPECIAL ELECTION TO BE HELD ON THE 19th DAY OF MAY, 1992, THE QUESTION OF WHETHER OR NOT TO ADOPT A CHARTER AMENDMENT PROHIBITING THE CITY FROM PROMOTING HOMOSEXUALITY AND OTHER LISTED BEHAVIORS BY PROHIBITING RECOGNITION OF HOMOSEXUALITY AND OTHER BEHAVIORS UNDER TERM OF SEXUAL ORIENTATION, SEXUAL PREFERENCE AND SIMILAR PHRASES; PROHIBITS CITY AGENCIES AND DEPARTMENTS FROM PROMOTING, ENCOURAGING OR FACILITATING HOMOSEXUALITY AND OTHER LISTED BEHAVIORS. AMENDMENT NOT TO BE CONSTRUED AS NULLIFYING ANY CITY, STATE OR FEDERAL CIVIL RIGHTS PROTECTIONS BASED ON RACE, RELIGION, COLOR, SEX, MARITAL STATUS, FAMILIAL STATUS, NATIONAL ORIGIN, AGE OR DISABILITY, NOR TO FORBID CITY ADOPTING PROVISIONS PROHIBITING EMPLOYMENT DECISIONS BASED ON FACTORS NOT DIRECTLY RELATED TO EMPLOYMENT; REFERRING SAID QUESTION TO THE ELECTORS OF THE CITY OF SPRINGFIELD BY INITIATIVE PETITION, FOR THE ELECTORS' APPROVAL OR REJECTION, PROVIDING FOR THE MANNER OF ELECTION AND ALL ACTS NECESSARY FOR CARRYING ON SAID ELECTION AND DECLARING AN EMERGENCY. THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: That a special election shall be held in Springfield, Lane County, Oregon, on Tuesday, May 19, 1992. There shall be submitted to the electors and legal voters of said City for their approval or rejection, the following question: (Attached hereto as Exhibit "A" and incorporated herein by reference as fully and completely as though set forth in full herein). Section 2: Said question shall be placed upon official ballots by the City Recorder to be voted upon by the electors of the City of Springfield at said special election. The City Recorder may provide for such official ballots by arranging for their insertion upon the election ballots provided by the County Department of Records and Elections. Section 3: The City Recorder shall provide or cause to be provided such poll books, ballots, ballot boxes, tally sheets and other supplies for the hereinafter specified polling places as are necessary for the carrying on of the election which shall be delivered to the election boards by the City Recorder or shall be caused by her to be delivered thereto. Section 4: The city and county precincts of the city of Springfield shall be uniform in boundary and have the same election boards and polling places in the City and said election shall be in the same places as provided for by the County of Lane for the special election to be held on the 19th day of May, 1992, and said chairman and clerks .in the said special election shall be identical to the ones serving in said City of Springfield special election. Ordinance - Page 1 . . . ~, Section 5: The polls shall be open at each of said polling places at 8:00 a.m. and shall be closed at 8:00 p.m. on said election day. section 6: Notice of said election shall be given by the City Recorder publishing notice thereof in The Springfield News, a newspaper prepared and published in Springfield, Oregon, by two publications of said notice, the first of which publication shall be not less than ten days prior to the time of the election. section 7: In the event the Lane County Elections Administrator shall timely and lawfully exercise his discretion to require said special election balloting to be conducted by mail, then the manner of election shall be in all respects consistent with the applicable requirements of Title 23 of Oregon Revised Statutes (Chapter 246 through 260), Chapter 805, Oregon Laws 1981, as amended, and Chapter 1, Article 16 of the Springfield Code 1965. Section 8: It is hereby found and determined that matters relating to the special election called for by initiative petition are matters affecting the public health, safety and welfare and that an emergency therefore exists, and that this Ordinance shall take effect immediately upon its passage by the Council and approval by the Mayor. QUESTION: Shall Charter be amended to prohibit City recognition of homosexuality, other behaviors as sexual orientation, and from promoting these behaviors? SUMMARY: Amends Springfield Charter. Prohibits City recognition of homosexuality, pedophilia, sadism and masochism, under term(s) sexual orientation, sexual preference and similar phrases. Prohibits city of Springfield agencies and departments from promoting, encouraging or facilitating homosexuality and other listed behaviors. Amendment not to be construed as nullifying any city, state or federal civil rights protections based on race, religion, color, sex, marital status, familial status, national origin, age or disability, nor to forbid city adopting provisions prohibiting employment decisions based on factors not directly related to employment... . .
