ORDINANCE NO. 5620
(GENERAL)

AN ORDINANCE PERTAINING TO SANITATION, GARBAGE COLLECTION
RATES, COUNTY USER FEES, RECYCLING, AMENDING SUBSECTION (2) OF
SECTION 4-2-5 AND ADDING A NEW SUBSECTION (6) TO SECTION 4-2-6 OF
ARTICLE 2 OF CHAPTER IV OF THE SPRINGFIELD CODE 1965, PROVIDING AN
EFFECTIVE DATE AND DECLARING AN EMERGENCY.
THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS:
section 1: Subsection (2) of section 4-2-5 of the
Springfield Code 1965, be and it hereby is amended to read as
follows:
"(2) Maximum rates to be charged for the collection of
garbage and refuse for a month shall be as follows:
(SEE EXHIBIT "A" ATTACHED HERETO AND
INCORPORATED HEREIN BY REFERENCE). ***"
section 2: There is hereby added to section 4-2-6 a new
subsection to read as follows:

"(6) Licensee shall provide the opportunity to recycle to
all customers which shall at all times comply with the
requirements of ORS 459A.005-459A.085 (former ORS
459.165-459.200) and ORS 459.250, including utilization of
the required elements contained in ORS 459A.010(2) (a), (b),
(c) and (h), together with all applicable rules and
regulations promulgated thereunder by the State of Oregon
Department of Environmental Quality and as provided in
section 6 of Ordinance No. 5395 (Special) as amended
coincidentally with the adoption of this subsection."
Section 3: This Ordinance shall become effective on
April 1, 1992.
Section 4: It is hereby found and determined by the
Common Council of the City of Springfield that matters pertaining
to the sanitation, garbage collection, rates to be charged
therefore and recycling, are matters affecting the public health
and safety of the City of Springfield and that an emergency
exists, and that this Ordinance shall therefore become effective
on the above date upon its passage by the Council and approval by
the Mayor.
Adopted by the Common Council of the City of Springfield
this 16th day of March , 1992, by a vote of 5
for and 0 against.
