HomeMy WebLinkAboutOrdinance 5614 03/02/1992 . . . i' 'E- ?' ORDINANCE NO. 5614 AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD METROPOLITAN AREA PUBLIC FACILITIES PLAN (PFP). THE CITY OF SPRINGFIELD FINDS THAT: 1. The proposed amendments to the Eugene-Springfield Metropolitan Area Transportation Plan (TransPlan), listed and shown on the map in Attachment D of Order No.'s 91-04- 50,91-04-51,91-04-52,91-05-66, and 91-05-67, also must be incorporated into Chapter VI of the Public Facilities Plan (PFP). The proposed amendments to the PFP are consistent with the text of the Eugene-Springfield Metropolitan Area General Plan, applicable state statutes, and applicable Statewide Planning Goals and Administrative Rules, pursuant to section 8.030 of the Springfield Development Code. 2. The Springfield, Eugene, and Lane County Planning Commissions held public hearings on the Gateway Refinement Plan and associated PFP amendment proposals on October 2, 1991. The Springfield Planning Commission unanimously recommended adoption with certain modifications. 3. The Springfield and Eugene City Councils and the Lane County Board of Commissioners held a public hearing on January 29, 1992 on the proposed Gateway Refinement Plan and associated PFP amendment proposals, as well as the Springfield Planning Commission recommended changes. 4. Findings in support of amending the PFP as recommended by the Springfield Planning Commission in conjunction with the adoption of the Gateway Refinement Plan, are set forth in Attachment E of Exhibit A, attached hereto, and are incorporated herein by reference. NOW, THEREFORE, BASED ON THE ABOVE FINDINGS, THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: Chapter VI of the PFP is hereby amended to incorporate the projects listed in Attachment E of Exhibit A, which is attached hereto and incorporated herein by reference. Section 2: The findings of the Springfield Planning Commission, Order No.'s 91-04-50, 91- 04-51, 91-04-52, 91-05-66, and 91-05-67, have been reviewed and are hereby adopted in support of the adoption of the PFP amendments as listed in Attachment E of the Orders. Order No.'s 91-04-50,91-04-51,91-04-52,91-05-66, and 91-05-67 are attached hereto and incorporated herein by reference. Section 3: This ordinance shall not become effective until ordinances adopting identical amendments to the PFP are adopted by the Eugene City Council and the Lane County Board of Commissioners. Section 4: It is hereby declared to be the intent of the Common Council that the provisions of this ordinance are severable and if any provision, clause or part is held illegal, invalid or . . . #< Ordinance 5614 Page 2 ~ unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity, unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions, clauses, or parts of the ordinance or their application to other persons and circumstances.
