ORDINANCE NO. 5612
AN ORDINANCE LEGISLATIVELY REZONING LAND IN ACCORDANCE WITH THE GATEWAY
REFINEMENT PLAN, AND AMENDING THE OFFICIAL ZONING MAPS MAINTAINED BY THE
CITY OF SPRINGFIELD DEVELOPMENT SERVICES DEPARTMENT.
THE CITY OF SPRINGFIELD FINDS THAT:
1. Pursuant to section 12.030 of the Springfield Development Code (SDC), the zone
changes proposed in conjunction with the Gateway Refinement Plan, as amended by
the "Springfield Planning Commission Recommended Changes to the Draft Gateway
Refinement Plan," are consistent with the Eugene-Springfield Metropolitan Area
General Plan (Metro Plan) Diagram and text, with the Gateway Refinement Plan (as
amended by the Springfield Planning Commission recommended changes); a minimum
level of key urban services can be provided to the properties prior to or in conjunction
with development; conflicts involving site-specific natural resources and/or hazards as
identified in the Metro Plan have been satisfactorily resolved; and conflicts with
neighboring land uses have been satisfactorily resolved or can be resolved by using the
Site Plan Review process in accordance with SDC Article 31.

The Springfield, Eugene, and Lane County Planning Commissions held public hearings
on the Gateway Refinement Plan and associated legislative zone change proposals on
October 2, 1991. The Springfield Planning Commission unanimously recommended
adoption with certain modifications.
3. The Springfield and Eugene City Councils and the Lane County Board of
Commissioners held a public hearing on January 29, 1992 on the proposed Gateway
Refinement Plan and associated legislative zone change proposals, as well as the
Springfield Planning Commission recommended changes.
4. Findings in support of legislatively rezoning certain properties in conjunction with the
adoption of the Gateway Refinement Plan as amended by the Springfield Planning
Commission, are set forth in Attachment C of Exhibit A, attached hereto, and are
incorporated herein by reference.
NOW, THEREFORE, BASED ON THE ABOVE FINDINGS, THE CITY OF SPRINGFIELD DOES
ORDAIN AS FOLLOWS:
Section 1: The Plan Diagram and plan policies of the Gateway Refinement Plan determine the
zoning of land within its jurisdictional boundaries.
Section 2: The legislative rezoning proposals, including the specific properties and the current
and proposed zoning districts, are listed by Assessors Map and Tax Lot numbers, and are
shown on the map in Attachment C of Exhibit A.
Section 3: The findings of the Springfield Planning Commission, Order No.'s 91-04-50, 91-
04-51, 91-04-52, 91-05-66, and 91-05-67 have been reviewed and are hereby adopted in
support of the legislative rezoning of land as described Attachment C of the Orders. Order

No.'s 91-04-50, 91-04-51, 91-04-52, 91-05-66, and 91-05-67 are attached hereto and
incorporated herein by reference.
Section 4: The Development Services Director of the City of Springfield is hereby directed
to cause the zoning maps maintained by the Development Services Department to show the
changes as listed in Attachment C of Exhibit A.
Section 5: The legislative rezonings prescribed by this ordinance will not go into effect until
the Eugene-Springfield Metropolitan Area General Plan Diagram has been amended by the
Eugene City Council and the Lane County Board of Commissioners to reflect the changes
recommended in the Gateway Refinement Plan, which also must be adopted. The legislative
rezonings outside the Springfield city limits will not go into effect until the Lane County Board
of Commissioners adopts identical ordinances effecting these changes.
Section 6: It is hereby declared to be the intent of the Common Council that the provisions
of this ordinance are severable and if any provision, clause or part is held illegal, invalid or
unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity,
unconstitutionality or inapplicability shall not affect or impair any of the remaining provisions,
clauses, or parts of the ordinance or their application to other persons and circumstances.
