HomeMy WebLinkAboutOrdinance 5605 01/21/1992 rI 0 /'_- ': 'lP~ '9218984 ORDINANCE NO. 5605 AN ORDINANCE VACATING CERTAIN STREETS AND ALLEYS PLATTED AS PART OF THE RAILROAD ~DDITION SUBDIVISION, IN THE CITY OF SPRINGFIELD, LANE COUNTY OREGON. WHEREAS, the Springfield City Council has declared its intention to vacate portions of various streets and alleys platted as part of the Railroad Addition Subdivision in the City of Springfield as attached; and WHEREAS, such vacation is in the best interest of the City in carrying out its plans and programs for the general development of the City; and WHEREAS, lawful notice of the proposed vacation was published and posted; and WHEREAS, the Springfield City Council met in Council Chambers, at 225 Fifth Street, on Monday, the 6th day of January, 1992, at the hour of 7:30 p.m., to hear any objections to the proposed vacation and ~ persons appeared to object; NOW, THEREFORE, THE CITY COUNCIL DOES ORDAIN: 22~~APR.08'92"OlREC 22~~APR.08'92"OlPFUND 1B:88 Section 1: The Council finds that legal notice of the hearing was lawfully published and posted; that 0 objections were made at the vacation hearing held; that public interest will not be impaired by the vacation of the public right-of-way and that said right-of-way vacation will be to the best interest of the public and increase the benefit of the property involved. Section 2: The following described public rights-of-way in the City of Springfield is declared to be vacated, being generally described below: . See Attachment A Section 3: The findings in the staff report for Jo. No. 91-07-116 are hereby made part of this Ordinance by reference. Section 4: The City Recorder is directed to file certified copies of this Ordinance with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor. Section 5: In order to guarantee the protection of utilities which lie under or are above the rights-of-way being vacated, easements for the following public utilities are hereby reserved: See Attachment B Rosboro Lumber Company and its heirs, successors and assigns shall have the right to relocate any such utility easement at its expense. Section 6: In order to protect any utility which may have been inadvertently omitted under Section 5 of this ordinance, it is a further condition of this vacation that nothing herein contained shall cause or require the removal of or abandonment of any PUBLIC sewer, water main, gas main, conduit of any kind, pole or thing used or intended for any public service or any easement therefore. The right is hereby reserved for the owner of any such utility or thing to maintain, continue, repair, reconstruct, renew, replace, rebuild and enlarge any and all such things under existing or future easements. Accordingly, Rosboro Lumber Company and its heirs, successors and assigns may negotiate with the various etility owners to relocate existing utilities, lines and easements at the expense of .osboro Lumber Company and its heirs, successors and assigns.
