Work Session Minutes
MINUTES OF THE MEETING OF THE
SPRINGFIELD CITY COUNCIL HELD
MONDAY, OCTOBER 17,1994
The City of Springfield Council met in Springfield City Hall, Meeting Room 2, 225 Fifth Street,
Springfield, Oregon, on Monday, October 17, 1994, at 6: I 0 p.m. with Council President Burge
presiding. Present were Councilors Burge, Shaver, Walters, Beyer and Maine. Mayor Morrisette
and Councilor Schanz were absent (excused). Also present were City Manager Mike Kelly,
Assistant City Manager Gino Grimaldi, City Attorney Joe Leahy, City Recorder Eileen Stein,
Development Services Director Susan Daluddung, Planner II Lydia Neill, Planner II Mel Oberst
and members of staff.
I. Historic Commission Interview
The Council interviewed Jack Gischel for one vacancy on the Historic Commission. Council
previously interviewed Ross Sutherland and Stephen Keating on October 3, 1994. The interview
questions asked were as follows:
1) Why are you interested in serving on the Historic Commission?
2) Is there anything the Springfield Historic Commission could do better?
3) Do you feel it is the City's right to apply a historic designation to a property without the
consent of the property owner?
4) Can you attend Historic Commission meetings?
5) What do you hope to accomplish, if selected to the Historic Commission?
The Council discussed the candidates qualifications. The appointment will be made during the
regular meeting later that evening.
2. Springfield Development Code Article 37
Development Services Director Susan Daluddung provided background on the topic. She
described how phased development legislation evolved in the state of Oregon. She indicated that
the MountainGate developers were present, as was Mrs. M.J. Higgins, who testified at the
Planning Commission public hearing when Article 37 was discussed. She stated Planner II Mel
Oberst was available to review the proposed ordinance with the Council.
Councilor Burge asked why the Planning Commission is revisiting the minimum lot size
standards. Ms. Daluddung replied it was in response to testimony given by Mrs. Higgins during
the public hearing.
Councilor Shaver asked why state legislation allowed for phased subdivisions to occur. Ms.
Daluddung discussed the intention of the legislation and stated that phased developments can
also be applied to industrial and commercial properties. She explained it allows for long term
developments to occur without changes. City Attorney Joe Leahy stated that by allowing a
phased subdivision, the Council is making a commitment to a developer that they may not be

able to back away from later on. He stated it has impact on future Council's ability to change
directions based on citizen input down the line.
Councilor Maine asked how a citizen would learn that there are long term development plans for
a vacant lot. Mr. Oberst explained the information would be provided by the City at the time a
citizen made an inquiry regarding such property.
Councilor Shaver asked questions regarding specific elements in the ordinance regarding type of
planning procedure, timing, extensions, phasing of public improvements, and protections if a
developer defaults. Mr. Leahy proposed that the Council consider requiring the developer to pay
a performance bond at the time the development begins. Mr. Oberst clarified that such a
requirement was already included in the ordinance.
Councilor Burge called upon Laurie Adams who represents MountainGate developers Mel
Mason and Howard Kanengiser. Ms. Adams discussed the intentions of the developers to
comply with the ordinance.
Councilor Burge recommended a requirement that the master plan be recorded. Council
discussed adding such a requirement.

Mr. Mason commented on the Council's discussion. He indicated a bond was required by the
ordinance. He also described the development phasing schedule and presented the proposed
development master plan to the Council.
3. Business from Council
There was none.

The meeting adjourned at 7:00 p.m.
