City of Springfield Work Session Council Meeting MINUTES OF THE MEETING OF THE SPRINGFIELD CITY COUNCIL HELD MONDAY, JUNE 21, 1993 The City of Springfield Council met in the Springfield City Hall, Meeting Room 2, 225 N. Fifth Street, Springfield, Oregon, on Monday, June 21, 1993, at 6:00 p.m. ATTENDANCE Present were Councilors Schanz, Burge, Beyer, and Shaver. Mayor Morrisette and Councilors Maine and Walters were absent (excused). Also present were Assistant City Manager Gino Grimaldi, City Attorney Joe Leahy, and members of staff. 1. Teen Center Funding Community Development Management Analayst Lynn Nakamura gave a brief staff report regarding the funding request by the Teen Center. She introduced Artie Mae Harlow, Tammy Fitch, Joe Grosso and Stephanie Gaither who were present representing the Teen Center. Ms. Fitch asked the Council for $7,500 from the city's opportunity fund to purchase portable sound, stage and building equipment. She clarified the money would be used to purchase equipment and not to pay for labor costs. Ms. Harlow added that equipment such as tiolets and urinals will be installed portable, so they could be moved in the future. Councilor Shaver asked what would happen to the equipment in the future, if the Teen Center should close. Ms. Harlow replied it would be donated back to either the city or Willamalane Parks and Recreation. Councilor Burge asked if Ms. Harlow could provide the city with an inventory list. Ms. Harlow answered yes. The Council and Teen Center representatives discussed donations and door receipts, which would support the project through September. Ms. Harlow explained donations are being handled though the Lively Fund at Willamalane Parks and Recreation. Councilor Burge suggested the Council remove the original 50% match requirement per their tentative approval of the funds in June of 1993. After discussion, the Council agreed to give the Teen Center the money in good faith, and that the Teen Center would agree to continue seeking donations. IT WAS MOVED BY COUNCILOR BURGER WITH A SECOND BY COUNCILOR SHAVER TO GIVE THE SPRINGFIELD TEEN CENTER, VIA THE LIVELY FOUNDATION, $7,500 FROM THE CITY'S OPPORTUNITY FUND. THE MOTION PASSED WITH A VOTE OF 4 FOR AND 0 AGAINST. . City of Springfield Work Session Council Meeting Page two 2. Solicitation in Public Right-of-Way Acting Police Chief Dick Golden gave the staff report and referred to the document given to Councilors which was exempt from public disclosure pursuant to Oregon Revised Statues 192.501(1) "Public Records Pertaining to Litigation" and 192.500(2) "Internal Advisory Communications". Chief Golden stated there are no Attorney General opinions regarding solicitation in public right-of-way, and that he had discussed this issue at length with both City Prosecutor Dave Logan and City Attorney Joe Leahy. He explained the interpretation is varied regarding solicitation, but ORS 814.090 could be contested. Mr. Leahy gave details on state laws regarding impeding traffic flow and said the opportunities for enforcement due to safety are limited. He explained the city could post the law if it was state statue or local ordinance. . Councilor Shaver asked if it would be most cost effective to charge violators on state law versus city ordinance. Chief Golden responded by state law. He explained the state statutes wording is well known and only requires slight interpretation. He felt in the long run it would be less work to use state law and enforce by a uniform traffic citation. The Council discussed the options of adopting a city ordinance versus using the state statues and the processes for each option. Mr. Leahy stated ORS 814.090 does give cities the opportunity to site for traffic hazards. Mr. Logan felt he could successfully argue a case using ORS 814.090, and discouarged the Council from creating and ordinance that may conflict with state law. He explained the uniform traffic citation would be classed as a Class C Misdemeaner and would carry a small fine. Mr. Leahy told the Council the state statues may not address all of the Council's safety concerns. He referred to a solicitor holding a sign reading "Need York" and a motorist throwing change to the solicitor. He explained that under the state law, that would not be a violation of 814.090. The Council discussed safety issues, particularly the freeway exit/entrance off of Pioneer Parkway which was felt to be a hazard with frequent accidents. Councilor Shaver spoke of shift changes by solicitors and the flow of traffic being disrupted. Chief Golden explained solicitors would be allowed on the right-of-way, but could not cross the plain onto the road's edge, or would be violating the state law. Councilor Burge agreed and said that would address the safety issues. He recommended the Police Department strictly enfore 814.090 and the city to aggressively prosecute violators. . Mr. Logan stated he felt comfortable agruing the state statue based on the potential of a hazard. Mr. Leahy explained the judges will have to decifer the potential hurdles. . . City of Springfield Work Session Council Meeting Page three The Council agreed by consensus to direct Police to enforce ORS 814.090. Mr. Logan clarified a violation would be a person standing on the curb, reaching out or in a raodway. 3. Business from Council Councilor Schanz announced there may be testimony on the S. 52nd street project assessment. There was a brief discussion of the issue. Councilor Shaver stated Lane-On-Line is seeking funding for bulletin board information to be used by computer users who pay a yearly fee. He explained the system gives access to the public of information that may otherwise take staff time and resources to provide. He said former Planning Commission member Tom Atkinson is the director of the program. Councilor Burge asked for more information on the program, as the initial explanation was not detailed enough. Councilor Shaver suggested this could be a project that the city's Communication Manager could possibly take on. Mr. Grimaldi stated the topic could scheduled for a future work session. ADJOURNMENT .
