I'll inform the building inspector that temporary occupancy of the 'space would be permitted if all the other Minimum Development Standards on the site are met and installed. The only requirement that would inierfere with the construction of the sidewalk project is the decorative fence to be located immediately behind the front property line (condition 1 of the decision). We could delay this condition also until ODOT work is complete. The remaining conditions of the MDS are on the north side of the building and would need to be completed before temporary occupancy is issued. Thanks again for finding a solution to this unusual sidewalk situation. The District Office is currently pursuing ,oDOT funding for this small project. If this sidewalk project is approved, it could take several months to implement and cl;>nstruct. ODOT is currently processing an approach application for 2422 Main Street and our preliminary research indicates that ",:e will likely approve a single approach to Main Street serving this property. If agreement between the 2422 Main Street property representative is reached and the ODOT project is funded, would the City desire to issue an occupancy permit to allow the business to open prior to sidewalk completion? I believe ODOT would likely agree to this direction if the City is in agreement. .
