Mitch,
As per the Minimum Development Standards decision a Final Plot Plan showing all other
conditions will need to be submitted. A note should be placed on the plan stating that the
r approach location and ODOT access permit are currently under review. After the F'inal Plot Plan
:' is submitted and approved the Development Agreement needs to be signed by the owner. All of
,! the other conditions of the MDS with the exception of the submittal of the ODOT access permit,
ii construction .of the approach and sidewalk and the decorative fence placement along Main Street
" (Conditions 1 and 10) need to be completed before occupancy of the new area of the building.

,: (1) Your application for the second approach (app 8083) will need to be withdrawn in writing. If it
il is not withdrawn ODOT will have to require that you submit a traffic study showing the need for

:' (2) If the second application is withdrawn then we will need to extend the processing timeline for
:, the first approach (app 8086) due to the extra time needed to work with the multiple property
, owners and design the sidewalk project. The applicant and ODOT need to both agree to the time
" extension, if you are agreeable to this then Lynn can send a time extension letter to you.
, I have been in correspondence with Liz Miller regarding getting your occupancy permit and
ODOT supports this if we can get the two items above out of the way.

I spoke with Ramona on Friday and we are certainly on board for FM Enterprises, Inc dba The
Alibi with idea of using some of your funds from bikes and Ped, it appears to be the less
': expensive alternative and appreciate you and your staffs efforts. I will communicate with the 2
. adjacent owners and do my best to get them on board as well. In either case. we would prefer
this alternate, but if it fails we would proceed with what we have talked to Carl about below,

Hi Jim,
I looked at your markings today and it looks acceptable. One outstanding issue is what
length do you propose the transition from 10% to 2%?
Also, it was my understanding that the Alibi was closed by order of the City until the
access work was completed. It was obviously open today. Is it just the "new" area that
can't be used? If the Alibi is open is there some other urgency to complete this project?
