19th St Annexation

The City of Springfield is pursuing an annexation of the portion of 19th St between Yolanda and
to facilitate future development of the surrounding area and avoid conflicts with Lane County,
The City of Springfield and Lane County currently share jurisdiction of 19th St with each controlling
half the ROW divided at the centerline, The city is pr,?posing to annex the county administered half of 19th
St. The street will remain in its 'current condition (unimproved) with no changes until the Jackson Property
(the large parcel to thewest-TL 17-03-24-31-02000) is developed, As part of the annexation agreement for
this parcel the full width of 19th St will be improved when development occurs within the Jackson Property,
at a future date to be determined by the property owner.
No additional development will be allowed along this road until the full width is improved and able
to support an increased traffic load to the subject parcel. The current arrangement for improvements to 19th
St is for Vera Drive to be extended to form a connection to 19th St and then 19th St to be improvement along
the frontage of the Jackson Property with limited access to unimproved portions of 19th St.

Beginning at the Initial Point of Land Partition Plat No, 92-P0306, as filed for public
record in the Office of the Lane County, Oregon Surveyor, in County Surveyor's File No,
31021, on January 4, 1993; thence on the following five (5) numbered courses:
1) North 000 03' 28" West a distance of 170.00 feet along the Westerly line of the said
partition plat to a point on the North right of way line of Hayden Bridge Road; thence
. 2) North 890 58' 29" East a distance of 35.00 feet along the Northerly right of way of
Hayden Bridge Road to a point; thence
3) leaving the North right of way line of Hayden Bridge Road, crossing the road and
along the Easterly right of way line of 19th Street, South 000 03' 28" East a distance of '
986,99 feet to a point of curvature in the easterly right of way; thence
4) leaving the Easterly right of way of 19th Street and crossing it at right angles, South

RESOLUTION NO 09-23
A RESOLUTION INITIATING ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF
SPRINGFIELD PURSUANT TO SECTION 5,7 OF THE SPRINGFIELD DEVELOPMENT CODE.
WHEREAS, the City Council is authorized by Section 5,7-125 of the Springfield Development
Code to initiate annexation of contiguous property to the City Limits of Springfield, and
WHEREAS, the property to be annexed is publicly owned property and rights of way of the State
of Oregon, and
WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth Boundary,
is contiguous to the City of Springfield and can be provided with a full range of key urban services
including sanitary sewer. water, storm drainage. police and fire protection, electrical service, land
use controls, street lights and paved streets, recreational facilities and library,
WHEREAS, annexation procedures shall be initiated and followed in accordance with the public
notice and hearing process, criteria of approval and ordinance adoption procedures contained in
Springfield Development Code Section 5,7- Annexations.
NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS:
Section 1: The Common Council of the City of Springfield does hereby announce its int13ntion to
conduct public hearings to consider annexation of territory generally described as. publicly owned
right-of-way along a portion of 19th Street from the intersection with Hayden Bridge Road
sou1herly, This property is depicted and more completely described on the attached Exhibits 1
and 2, .
Section 2.. This Resolution shall become effective upon its adoption by the Council and approval by
the Mayor.

Re: Annexation of 19th Street
Thank you for requesting comment on an annexation proposal concerning North 19th Street. The City of
Springfield is proposing to annex a portion of N, 19th Street, a Public Road (also called a "Local Access
Road" or LAR) that is within the Springfield Urban Growth Boundary. Lane County is generally supportive of
the transition to urbanization of LARs, due to the County's limited authority to improve them pursuant to OR S
368,031, which states;
"A local occess rood that is outside a city is subject to the exercise of jurisdiction by a county governing
body in the same manner as a caunty road except as follows:
(1) A caunty and its officers, employees or agents are not liable for failure to improve the local access
road or keep it in repair. ,
(2) A county governing body shall spend county moneys on the local access road only if it determines that
the work is an emergency or if:
(a) The county road officiol recommends the expenditure;
(b) The public use of the road justifies the expenditure proposed; and
(c) The county governing body enacts an order or resolution authorizing the work and designating the work
to be either a single project or a continuing program."
It is unlikely the County will ever prioritize any portion of N. 19th lor improvement due to its LAR status, limited
funds, and other priorities. Therefore, this proposal raises some concerns regarding the segment connectivity
to the north that is not proposed for annexation, and connectivity that will result from the annexation of the
north segment. The proposal is to develop the Jackson property with a 3D-lot subdivision, and improve only
the adjacent section of 19th Street to urban standards. This plan leaves approximately 350 feet of unimproved
LAR between the south end of the proposed improvements and Yolanda Avenue, a Lane Countyfadlitythat
has been fully improved to.urban standards. Once this connection is developed, it is a certainty that this
development will significantly increase daily traffic on the unimproved section, There will also be a lack of
transition between the section that will be improved and the unimproved portion, and there are no curb returns
at the south end at the intersection with Yolanda, only a standard driveway approach. Essentially the segment
that is not proposed for annexation is currently functioning like a driveway and will be handling a significantly.
increased level of traffic, which in turn, unfairty increases the maintenance responsibilities of the adjacent
property owners.
Lane County would support a proposal that transfers jurisdiction of North 19th Street in its,entirety, in order for
the City to be sole authority for land use and the public right-of-way and to require adequate road
improvements on the entire length of North 19th Street. Absent that, we will request that barriers be erected at
the southern terminus of the segment of North 19th Street adjacent to be annexed, assuming alternative
access is available to properties to the north. .
