Land Use Compatibility Statement for 1448 Main Street, Assessor's Map 17-03-36-
32, Tax Lot 2900 .
The above referenced property is zoned CC Community Commercial and designated for
Commercial use in the Metropolitan Area General Phin.
The CC zoning district allows hotels and motels as outright permitted uses, but multiple
family development is only allowed in areas designated Mixed Use in the Metro Plan or
refinement plan. This property is not designated for Mixed Use iri the Metro Plan.
Our address files indicate that this property has been developed with 12 apartments since
at least 1977. Based on the fact that this property is not designated for mixed use in the
Metro Plan, the use of this property for apartments is considered a non-conforming use in
the CC district. The apartment use on this property may continue as a non-conforming
use as long as it meets the requirements for non-conforming uses in Article 5 of the
Springfield Development Code (SDC).
Article 5 of the Springfield Development Code outlines our regulations on non-
conforming uses. Under SDC Section 5.030 Continuance, .. a non-conforming use may
continue so long as it remains otherwise lawful, subject to the following limitation: (I)
Routine maintenance and repairs may be performed provided that repair work does not
exceed 50% of the replacement costs as determined by the Building Official. (2) Any
. non-conforming structure, which is determined to be substandard by the Building
Official, may be brought into compliance with the Building Safety Code..."
