RESOLUTION 09- 42
A RESOLUTION ESTABLISffiNG A LOCAL WASTEWATER COLLECTION SYSTEMS
DEVELOPMENT CHARGE, AMENDING RESOLUTION NO. 09-22 AND SETTING AN
EFFECTIVE DATE
WHEREAS, on January 20,2009, the council adopted Resolution 09-20 adopting a modification to the
Local Wastewater Systems Development Charge Methodology; and
WHEREAS, on January 20,2009, the council adopted Resolution 09-21 adopting a modification to the
Local Wastewater Systems Development Charge Project List; and
WHEREAS, by Resolution 09-22, the Council increased the rate of the Local Wastewater Systems
Development charge as follows: the Reimbursement component shall be $128.38 per drainage fixture unit
and the Improvement component shall be $62.66 per drainage fixture unit, for a total Local Wastewater
System Development Charge of$191.04 per drainage fixture unit; and
WHEREAS, by Resolution 09-22 the Council determined that rate should become effective as of July 1,
2009 for commercial and industrial developments, and as of October 16,2009, for single family and two
family residential development; and
WHEREAS, the City Manager, at a work session on September 28, 2009, advised the Council with
respect to the impact of delaying the increase in the residential rate; and
WHEREAS, based on the information provided by the City Manager, and information provided by the
public and all the facts and circumstances, the Council hereby finds and determines that while a further
delay in increasing the rate for single family and two family construction may have a beneficial impact on
the local economy, that action may have substantial adverse impact on the finances of the City; and
WHEREAS, for single family and two family residential construction the current Reimbursement
component is $28.99 per drainage fixture unit and the Improvement component is $22.05 per drainage
fixture unit, while for commercial and industrial development the Reimbursement component is $128.38
and the Improvement component is $62.66;
NOW THEREFORE, BE IT RESOLVED, that effective date of the Reimbursement component and
the Improvement Component of the Local Wastewater SDC for single family and two family residential
construction, fixed as October 16, 2009 by Resolution 09-22, shall be amended and revised to March 1,
2010; and
BE IT FURTHER RESOLVED, that the City Manager is directed to report to the Council on or before
March 1,2010, with recommendations for further action with respect to the Local Wastewater SDC rate
as it shall apply to one and two family residential development; and
BE IT FURTHER RESOLVED, that this Resolution shall take effect upon approval of the Council and
signature by the Mayor.
