HomeMy WebLinkAboutResolution 09-40 10/19/2009 CITY OF SPRINGFIELD RESOLUTION 09- ~ A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD TO STIMULATE AND ENCOURAGE THE DEVELOPMENT AND REDEVELOPMENT OF SINGLE FAMILY OR DUPLEX RESIDENTIAL HOUSING STARTS, TEMPORARILY AMENDING RESOLUTION NO. 08-27, THE AMENDED MASTER SCHEDULE OF MISCELLANEOUS FEES AND CHARGES, RATES, PERMITS, AND LICENSES ADOPTED THE 1ST DAY OF JULY, 2008, AS AMENDED BY RESOLUTION 09-02, ADOPTED THE 20TH DAY OF JANUARY, 2009, PROVIDING FOR DEFERRAL OF FEES AND CHARGES AT THE REQUEST OF THE PROPERTY OWNER FOR HOUSING STARTS DURING THE PERIOD OF TIME FROM THE EFFECTIVE DATE OF THIS RESOLUTION THROUGH MARCH 1,2010, EXTENDING THE EXPIRATION DATES OF ORDINANCE 6233 AND ORDINANCE 6234, AND SETTING AN EFFECTIVE DATE WHEREAS, on January 20,2009, the Council adopted Resolution 09-02, providing for deferral of the time of payment of certain fees and charges, in order to stimulate and encourage the development and redevelopment of single family or duplex housing starts; and WHEREAS, on January 20,2009, the Council enacted Ordinances 6233 and 6234, implementing Resolution 09-04; and WHEREAS, Resolution 09-02 authorized the deferral of the time of payment of certain fees and charges due or to become due on single family and duplex residential development; and WHEREAS, Resolution 09-02 provides, at paragraph 5, as follows: 5. Be2innin2/End Date. This Resolution and the deferral set forth herein shall be in full force and effect from the effective date through October 15, 2009, and unless extended by Resolution of the Council, on October 16, 2009 shall lapse and be of no further force and effect. And WHEREAS, on January 20,2009, the Council enacted Ordinance 6233, providing for authority for the City Finance Officer to implement assessments for the collection of deferred fees or charges set forth in Resolution 09-02; and WHEREAS, on January 20,2009, the Council enacted Ordinance 6234, allowing for the deferral of time of collection of certain fees and charges; and WHEREAS, Ordinance 6234 provides, at Section 7, as follows: Section 7. Be2innin2/End Date. The deferral set forth herein shall be in full force and effect from the effective date of this Ordinance through October 15, 2009, and unless extended by Resolution of the Council, on October 16, 2009 shall lapse and be of no further force and effect. And WHEREAS, the City Manager has provided information to the Council concerning the use and impact of the deferrals authorized by Ordinances 6233 and 6234 and Resolution 09-02, and has recommended that the deferrals authorized therein be extended through and including March 1, 2010; and WHEREAS, the Council this matter was brought forward for public hearing on October 19, 2009; and WHEREAS, the Council has considered the information and recommendation of the City Manager and the testimony provided at the public hearing and does hereby find and determine that continuation of the deferrals is in the public interest; NOW THEREFORE BE IT RESOLVED THAT, pursuant to paragraph 5 of Resolution 09- 02, the effective date of said resolution is hereby extended through and including March 1, 2010; and BE IT FURTHER RESOLVED THAT, pursuant to section 7 of Ordinance 6234, the effective date of said ordinance is extended through and including March 1, 2010; and BE IT FURTHER RESOLVED THAT, the effective date of Ordinance 6233 is extended through and including March 1, 2010; and BE IT FURTHER RESOLVED, that this Resolution shall take effect upon approval of the Council and signature by the Mayor. Adopted by the Common Council of the City of Springfield, Oregon, by a vote of -L for and ~ against, this _19th_day of _October _, 2009.
