Dear Mr. Crombie, Staff Decision: Preliminary Approval with conditions. Findin~s of Fact Request The request is for a Lot Line Adjustment to add square footage from property located at 1441 Main Street to property located at 177 South 14th Street. Back~round The subject properties are Tax Lot 5200 (1441 Main Street) and Tax Lot 4400 (177 South 14th Street), both located on Assessor's Map# 17-03-36-32. Criteria of Approval (Ref. Section 33.040 of the Springfield Development Code) The Lot Line Adjustment does not: 1. Create a new. lot or land-locked parcel; No new access Street. lots are proposed to be created. Reduce an existing lot below the minimum dimensions established by the applicable zoning district or otherwise violate the standards of the Springfield Development Code, or Structural Specialty and Fire and Life Safety Code standards; Both Tax Lot 5200 and 4400 are zoned and designated Community Commercial. The minimum street frontage is 50 feet; the minimum lot size in the CC District is 6,000 square feet. Both lots currently exceed the minimum street frontage standard of 50 feet; this request will not affect street frontage standards. Tax Lot 5200 currently contains approximately 6,720 square feet; upon Final Approval the lot will contain approximately 17,000 square feet. Tax Lot 4400 currently contains approximately 42,000 square feet; upon Final Approval the lot will contain approximately 31,800 square feet. Both lots will exceed minimum square footage standards. Both lots contain structures which will continue to maintain the required setback standards in relation to the adjusted property line. Decision Since the request complies with the criteria of approval, as conditioned, the proposed Lot Line Adjustment will be granted Preliminary Approval. The Springfield Development Code requires that a surveyor set new property pins and create new legal descriptions. Vhen the conditions listed below have been met, Final A~E!oval will be granted. Two copies of a survey showing the new property line. 2. New legal descriptions for each lot. Appeals This Lot Line Application is being processed under Type I procedure (Ref. SDC 3.070). Type I applications cannot be appealed. In the event that the applicant disagrees with the application of the standards, the applicant may request a Type II Interpretation. An appeal of a Type II decision may be filed by an affected party with the Development Services Department within 10 calendar days of the date of that decision.
