SET BACK WAIVER AGREEMENT KNOW ALL MEN BY THESE PRESEllTS, That for and in consideration or the City of Springfield, a municipal corporation in Lane County, State of Oregon, granting to the undersigned a waiver of the ordinances of the City of Springfield requiring a set back from the center Of~' Main Street of 60 feet, so that the undersigned may construct and maintain an advertising Si,[-;'l upon the following described real property, to-wit: Beginning at a point on the West line of 14th Street, 120.0 feet North of lthe North line of Haln Street, Springfield, Lane County, Oregon, running thence North on the West line of said 14th Street 80.0 feet, more'or less, to the South line of the alley extended East from Its present location, between Haln Street and 'A' Street at the West line of 12th Street, thence West 120.0 feet along the ,South line of saId alley If extended, thence South parallel with the East line of 12th Street 80.0 feet, more or less, which Is the same distance south of said alley lIne as the beginnIng point, and thence East parallel wIth the South line of said alley If extended, 120.0 feet to the place of beginning. ALSO: Beginning at a point on the South line of the alley be- tween Haln Street and 'A' Street In the City of Springfield, Lane County, Oregon, 120.0f eet West of the West line of 14th Street, from said beginning pol~t run South 80 feet, more or less, to the southwest corner of a tract conveyed by the grantors herein to W. W. Wheeler, by deed, Book 314, page 377, of Deed Records for ~ane County, Oregon; thence West 30 feet, thence North 80 feet more or less, to the South line of the alley, llhence East 30 feet more or less to the place of beginning, In Lane,County, Oregon. 1196 Haln Street known as number 1196 of Haln Street in the City of Springfield, Lane County, State of Oregon, but within the prohibited set back area as established by the ordinances of the City of Springfield, but not closer than 43.0 feet to the center line of Main Street, the undersigned applicant and permitee does hereby promise and agree that in the event the City of Springfield deems it necessary for any reason, and at the City's request the undersigned will, at his own expense, remove the above mentioned advertising sign promptly. This agreement shall be binding upon the undersigned who are the owners and/or lessees of the above described real property, and/or of said sign, and upon their successors and assigns, and anyone having an interest in said sign and/or in the above described real property.
