The property is flat and vacant. The property is zoned Community Commercial and is.designated Community Commercial in Metro Plan diagram. The property is not in any adopted refinement plan area. NOTICE OF DECISION JO. NO. 91-04-49 Page 2 CRITERIA OF APPROVAL (Ref. Section 31.060 of the SDC). (1) COMPLIANCE VITH THE SUBMITl'AL REQUIREMENTS OF SECTIONS 3.050 AND 31.050 OF THIS CODE. The application was accepted by the City on April 9, 1991. The existing landscaping stops approximately half-way along the west property line. Although the property immediately to the west is zoned Community Commercial, the applicant is strongly encouraged to continue the landscaping in the form of a laurel hedge to protect the existing residential use. The names and locations of the street trees need to be shown on the Final Site Plan. Building Code Issues The proposed use of a manufactured home as an office space is a commercial use. The manufactured home must be designed to comply with State Structural Code requirements for floor loads of 50#/sq.ft; with concentrated loading up to 2,000#. The manufactured structure must be labeled as complying with this requirement. The exit system must comply with. .code requirements for commercial occupancies. Setbacks a. Office structures which are located closer than 20 feet to the property line shall have walls facing. the property line protected by one-hour fire resistive construction, including a parapet wall extending 30 inches above the roof. Openings in such walls shall be protected by 3/4 hour fire rated assemblies when located between 5 and 10 feet from the property line. These dimensions must be shown on the Final Site plan. If the proposed office needs to be relocated, the new location must be shown on the Final Site Plan. Outside trash recePtacles Although no trash receptacles were shown on the plan submitted, any outside receptacles need to be screened from view and shown on the Final Site Plan. (3) ~M""..ORIED NATURAL (INCLUDING REGULATED'VETLANDS) AND HISTORIC FEATURES OF THE SITE HAVE BEEN ADEQUATELY CONSIDERED IN THE PROJECT DESIGN. There are no inventoried natural or historic features on this site. Access The existing driveway along Hain Street is oversized and marked wfth gouges from previous use. If the driveway is further det~riorated by the proposed use, a new driveway will be required to be constructed with a maximum width of 35 feet and 8 foot-wide flares. At that time, the driveway should have a straight grade from the back of the sidewalk to the curb line and be depressed 1" to 2" inches below the back of sidewalk grade. No additional access is being proposed or granted as part of this application. Parkin& The parking requirement for the manufactured home sales use is 1 space for each 300 square feet of gross floor area (sales and service), SDC 18.070(3). The five parking spaces shown on the plan submitted meet this requirement. The typical parking stall dimensions are 9' x 18'; these dimensions must be shown on the Final Site Plan. A bike rack will be required to be shown on the Final Site Plan. <.. Pavinp; The parking and circulation area will be required to be paved as shown on the plan submitted. An extruded curb or wheel stops will be required in the area where the parking spaces are shown. In addition, an extruded curb or other approved device will be required along the east end of the paving area to delineate the property line and aid in draining the property. WfVLU SITE PLAN REVIEY DEVELOPMENT AGREEMENT THIS DEVELOPMENT AGREEMENT, hereinafter "Agreement", is entered into this 7[/1 day of May, 1991 (the "Effective Date") by and between the CITY OF SPRINGFIELD, hereinafter "City", and Sycan B Corp., hereinafter "Applicant", in accordance wi th Section 31.090, and Sections 3.070(3), 3.080(3), 3,090(3), and 3.100(3). RECITALS * YHEREAS, on the Plans submitted by the j7.nV day of May, 1991, the City approved Applicant for the purpose of allowing: the Modified Site CITY JOURNAL NUMBER 91-04-49. Type II Site Plan Review to consider the establishment of a manufactured home dealership with a 12' x 60' manufactured home for office space. The property is located at 1250 Main Street and is currently vacant (Assessor's Map 17-03-35-41, Tax Lot 203). This property is zoned Community Commercial (CC); the Metro Plan designation is CC. Manufactured home sales (SDC 18.020(2)(d) is a permitted use, subject to Site Plan Review. YHEREAS, in consideration for Site Plan approval, the issuance of a Building Permit, and the issuance of an Occupancy Permit, as specified in the Springfield Development Code Section 31.090, Applicant agrees to comply with all the standards of the Springfield Development Code and Springfield Municipal Code which may be applicable to this development project unless modified or excepted by the Site Plan Review Development Agreement, Planning Director, Planning Commission, Building Official or their agents, or the Fire Marshal, which modifications or exceptions shall be reduced to writing. YHEREAS, in consideration for Site Plan approval, the issuance of a Building Permit, and the issuance of an Occupancy Permit, as specified in the Springfield Development Code Section 31.090, Applicant agrees to comply with the following specific conditions imposed by the City as part of the Site Plan approval: 1. The applicant has submitted a Final Site Plan in accordance with Section 31.080 of the Springfield Development Code. 2. STANDARDS. The applicant agrees to fulfill all applicable standards specified in the Springfield Development Code and the specific standards listed in RECITALS prior to occupancy, unless certain standards have been deferred to a later date in accordance with Section 31.110 of the Springfield Development Code. The Applicant agrees to fulfill all specific conditions of approval required by the City listed in RECITALS prior to occupancy, unless certain conditions have been deferred to a later date in accordance with Section 31.040(4)(b) of the Springfield Development Code. 4. MODIFICATIONS. The applicant agrees not to modify the approved Final Site Plan without first notifying the City. Modifications to the Final Site Plan shall be reviewed in accordance with Section 31.100 of the Springfield Development Code. 5. MAINTAINING THE USE. The applicant agrees to the following: (a) The building and site shall be maintained in accordance with the provisions of the Springfield Development Code in order to continue the use. (b) It shall be the continuing obligation of the property owner to maintain the planting required by Section 31.140 of the Springfield Development Code in an attractive manner free of weeds and other invading vegetation. Any Final Site Plan approved becomes null and void if construction does not commence within two years of the date of this Agreement.
