I have since visited the site on several occasions and ,'." '.' J ~...,..r 'I~: ,:~:"" would like to inform you about the Springfield Development Code requirements ': /". for business property improvement standards. .i . ;.".;'1 ,I, .,> " , , The City can require parking lots to be paved under the following conditions: " , 1. All new construction and expansion of commercial, industrial and multi-family residences. 2. Changes in the use category of an existing building or structure. (The use category refers to a grouping of land uses which have similar operating characteristics and land use impacts, Therefore, a change from an auto dealer- ship to a repair garage would not be a change in use, but a change from an auto dealership to a clothing store would be a change in use and would be required to go through site plan review which would specify paved parking lots.) This, then, is why the relatively new businesses of the Church of the Brethren and the Adult Bookstore were required to pave and the Woodworkers Union, an existing business, has an unimproved lot. It has always been City policy to allow existing uses to remain "as is" until such time as the use changes (as described above) or a new building or development is installed--this is true for paving or any other required site improvements. I cannot answer your question about the City not allowing more auto body shops at this site because they are permitted uses in the Community Commercial District provided that special standards are met for all new businesses. South 11th "Street" is a private easement and never has been public right of way. How that street is used is a private matter between the parties that are involved in the easement. However, since the easement has been used by the public for years, I would advise that you check with an attorney about what your rights are or are not with regard to closing or changing the status of the easement. In the case of Acme taking access from this easement, I'm still doing some research on this condition to determine if we can legally require any improvements to this already existing business.
