Building Permit C0M2009-00445 and Minimum Development Standards Review
(MDS) DRC2009-00005 '.
A recent site visit has shown that all conditions of building permit C0M2009-00445 and
MDS DRC2009-00005 have not been met. Specifically, condition one of the MDS
review has not been completed. Condition one refers to the MDS standard SDC 5.15-
l20A which states that a 5' wide'planter strip, including street trees, with approved
irrigation or approved drought resistant plants as specified in Sections 4.4c,! 00 and 4.2-
140 shall be installed between the sidewalk and parking area or buildings., The condition
stated the following: "Applicant shall install landscaping in the exterior planter strips in
the amount necessary to meet this standard as specified in SDC sections 4:4-100 and 4.2-
110."
The original Site Plan Review for the building shows the required planting and trees.
Street trees are required at 30 foot intervals along all sides of l'! property fronting a street.
Microsoft Live Search maps also show the trees recently on the site. The required trees
have been removed from the site and must be replanted as per the original Site Plan
Review approval and the current MDS approval. The building permit cannot be finaled
without the site conditions being completed. If this condition is not met by October 24,
2009 the case will be referred to Code Enforcement.
Please have the required trees planted by the date listed above and notify me when I can
conduct another site visit. I have enclosed the Street Tree List, which contains the type of
trees which can be planted, the size requirement for each tree and the location standards
for street trees. Trees must be a minimum 2" caliper in size to meet the required street
tree standard. I have also enclosed a copy of the MDS decision, signed Development

photograph.
