Executive Summary The City Surveyor and Development Services staff has reviewed the HoeraufSubdivision Plat and has inspected the public improvements required as a condition of approval of the Subdivision Tentative Plat and finds that the subdivision plat meets the approval criteria found in Section 5.12-145 of the Springfield Development Code. The subdivision is hereby approved. II. Plat Review Section 5.12-135 of the Springfield Development Code indicates that Plats are reviewed under Type I procedure. Section 5.1-125 of the SDC states that Type 1 decisions may be made by the Director "without public notice and without public hearing." Type 1 applications are to be reviewed for completen~ss and for conformance with the applicable criteria for approval of the proposal stated in the Development Code, Based OIi the Director's review, a decision is issued, which is the final decision of the City. Staff has reviewed the applicant's submittal for completeness requirements found in Section 5,12- 140 of the SDC. Stafffound the applicant's submission complete on August 5, 2008. m. Plat Approval Criteria Section 5.12-145 of the Springfield Development Code lists the criteria for approving subdivision plats. The criteria found in 5.12-145 are listed below together with staff findings and analysis with respect to these criteria. The Director, in consultation with the City Surveyor and City Engineer, shall approve ,or deny the Plat. Approval shall be baSed on compliance with the following criteria: A. The' City Surveyor has approved the Plat for compliance with applicable platting requirements in accordance with State law, Lane County Ordinances and any other applicable regulations. Finding #1. On August 5. 2008, the City Surveyor reviewed a revised mylar sheet showing notations that were added to the plat at the request of Development Services Department staff. The Surveyor had reviewed and signed the original plat on May 16,2008. B. Streets, bicycle paths, accessways, and alleys for public use have been dedicated without any reservation or restriction other than reversionary rights upon vacation. Finding #2. The applicant has submitted a Declaration of Joint Access and Private Utility Easements which guarantees street access to all parcels created by the subdivision. The Declaration includes easements which protect access to utilities and infrastructure on the site for maintenance and replacement. C. Public improvements, as required by this Code or as a condition of Tentative Plan approval, are completed, or: SUB2008-00027 HoeraufSubdivision Plat September 30, 2008 2 2. Finding #3. 1. A petition for public improvements and for the assessment of the real'property for the improvements has been signed by the property owner seeking.the land division and the petition has been accepted by the City Engineer; or A performance bond or suitable substitute as agreed upon by the City Engineer and the applicant has been filed with the City in an amount sufficient to assure the completion of all required public improvements. A site inspection by staff on August 5, 2008 confirms that the applicant has complied with the conditions of approval listed in the Tentative Plan decision (SUB2006-00057), D. Public assessments, liens, and fees with respect to the land division have been paid, or: 2. Finding #4. 1. A segregation of assessments and liens has been applied for and granted by the City, or An adequate guarantee in a form acceptable to the City has been provided assuring the liens, assessments and fees will be paid prior to recording the Plat. All public assessments, liens, andfees with respect to the land division have been paid. E. All conditions of Tentative Plan approval have been met and the Plat substantia,Ily conforms to the provisions of the approved Tentative Plan: Finding #5. A site inspection by staff on AugUst 5, 2008 showed that the applicant had not installed the "No parking Fire Lane" signs as required by the Fire Marshal for .the Tentative Plan, Afollow-up inspection on September 30,2008 confirms that the applicant has comDlied with the conditions of approval listed in the Subdivision Tentative Plat decision (SUB2006-00057). IV. Plat-Recording at Lane County and City Development Approval As required by Section 5.12-150 of the Springfield Development Code, after the Plat has been signed by the City, the applicant's surveyor or other designated person shall deliver the Plat to the Lane County Surveyor for recording. The applicant shall deliver a reproducible copy of the recorded Plat to the City Engineer, Once the City has proof that the Plathas been recorded, the parcels may be sold and the City may issue a Building Permit.
