DWP Time of Travel Zone 10-20 Year TOTZ Project Size 6000 square feet. I. Executive Summary This application is related to a proposed site plan application (DRC2008-00060). The applicant, Hamilton Construction, proposes construct a 6000 square foot fabrication building with associated utilities at its construction yard on South F Street. The fabrication building will bring together into one building, fabrication activities that are scattered across a number of existing buildings on site. This is the first phase of a multi- phase renovation of the construction yard which will include the eventual de~olition of some existing structures and the construction of new ones. DWP .review is 'a Type I application review process that requires n~ public notice or hearing. Staff review the proposed application against objective standards found in the Springfield Development Code (SDC), Section 3.3-235 Standards for Hazardous Materials within Time of Travel Zones. Section 3.3-235 prescribes standards prohibiting certain chemicals and setting standards for the handling and storage of other potentially hazardous materials that couId.damage Springfield's well fields and pose a threat to public health and safety. . Based on the information provided by the applicant, and staff findings stemming from an analysis of the proposal for compliance with the standards found in Section 3.3-235 of the Springfield Development Code, the Director concludes that the application is consistent with the stated development standards and. is thereby approved as conditioned. Procedural Requirements Section 3.3-225 C states that "Drinking Water Overlay District applications shall be reviewed under Type I procedures." Type I applications are ministerial in nature, meaning that they can be processed by staff without public notice or hearings. A mailed notice of decision is sent to the applicant (Section 1.2-120). Completeness Review SDC 3.3-225 (D) states: "Prior to undertaking an activity covered by Section 3.3-225 A., the owner or tenant shall submit a DWP Overlay District Application to the. City for review and approval. Application packets include required elements that are to be used for managing hazardous materials that may be a danger to the City's groundwater.. The section below lists the m ;~; I~~ required information and indicates whether the information included inthe application is complete. . 1) Hazardous Materials Inventory Statement and Material Safety Data Sheets. COMPLETE. 2) List of the chemicals to be monitored through the analysis of groundwater samples and a monitoring schedule if groundwater monitoring is anticipated to be'required. . NOT APPLICABLE 4) Description of the primary and any secondary contairunent devices proposed, and, if applicable, clearly identified as to whether the devices will drain to the storm or sanitary sewer. COMPLETE. 5) Proposed Hazardous Material Management Plan (HMMP) for the facility that indicates procedures to be followed to prevent, control, collect and dispose of any unauthorized release of a hazardous material. COMPLETE. 6) Description of the procedures for inspection and maintenance of containment devices and emergency equipment. . COMPLETE. 7) Description ofthe plan for disposition of unused hazardous materials or hazardous material waste products over the maximum allowable amounts including the type of transportation, and proposed routes. . . COMPLETE IV. Criteria for Permit Approval Type I decisions are made based on clear and objective standards that do not require staff discretion. Staff reviewed the application against the development standards found in Section 3.3-235 Standards for Hazardous Materi.als within Time of Travel Zones. Section 3.3-235 prescribes standards prohibiting certain chemicals and setting standards for the handling and storage.of other potentially hazardous materials that could damage Springfield's well fields and pose a threat to public health and safety. These standards vary according to the Time of Travel Zone (TOTZ) in which the subject property is located. The following section of this report shows the applicable standards for the TOTZ and makes findings that stem from a comparison of those standards with the . applicant's DWP submittal. Finding #1.. The subject property lies within the 10 - 20-year time of travel zone to the 16th & Q Street Well. The site is therefore governed by the 10 - 20 year Time of TravelZone (TOTZ) Standards in Springfield Development Code SDC 3.3-235 (D). Review Standards for the 10-20 year TOTZ SDC 3.3-235 (D) . . SDC 3.2-235 states that ''the storage, handling, treatment, use, production or keeping on premises of more than 20 gallons of hazardous materials that pose a riskto groundwater inaggregate quantities is allowed only upon compliance with containment and safety standards specifii:d.by the most recent Fire Code adopted by the City." , Drinking Water Protection Overlay District Application DRC2008-00067-Hamilton Construction October 30, 2008 3 'i Upon reviewing the applicants's submittal, against the standards found in SDC 3.3-235 (0), staff made the following fmdings: Finding #2. The Hazardous Materials Management Plan (HMMP) submitted with the application addresses product and container secondary containment, labeling, provision of spill kits, spill prevention, spill clean-up procedures, and employee training. Finding #3. The Hazardous Materials Inventory Sheet (HMIS) lists hazardous material storage areas. The site plan included in Appendix B of the HMMP shows the hazardous material storage locations listed in the HMIS but does not identifY them specifically as hazardous material. storage areas. Finding #4. Hamilton Construction has proposed to use spill basins,.spill pallets, and other devices to provide secondary containment for its hazardous materials storage. Finding #5. Section 4.1 of the HMMP inaccurately states that "The City of Springfield requires that all hazardous material containers ,must have secondary contairnnent regardless of type, quantity, or size." The DWP standards for approval for l'Wl'~' ~ies in the 10 - 20-year TOTZ state that "The storage, handling, treatment, use, application, or production or otherwise keeping on premises of more than 20 gallons of hazardous materials that pose a risk to groundwater in aggregate quantities is allowed only upon compliance with contairnnent and safety standards set by the most recent Fire Code adopted by the CitY." The secondary contairnnent requirements that apply to this site are as prescribed by the Fire Code. v; Conditions of Approval SDC 3.3-240 SDC 3.3~240 states: "The Director may attach conditions of approval that will minimize negative impacts of regulated substances on groundwater and ensure that the facility or the proposed development can fully meet the standards specified in Section 3.3-235.. These conditions may include, but are not limited to: on-site monitoring wells, Wellhead Protection Area signs, special storm water facilities or other conditions to address specific risks associated with the proposed development." Based on the findings made by staff, the applicant is required to comply with the following conditions are for approval ofthis application. Condition #1 The Hazardous Materials Inventory Sheet (HMIS) should be dated and include a note to be updated annually. Condition #2 The site plan map in Appendix B of the Hazardous Materials Management Plan (HMMP) must be labeled "Hazardous Material Storage Locations." Storage locations should be clearly identified on the map. It is acceptable to make this change with handwritten notes and color highlighting. Condition #3 During a site visit conducted on July30, 2008, SUB found that the site currently has areas of oil residue on the gravel and floor surfaces. Prior to occupancy,' all oil product or other hazardous material residue on the wound surface or in any uncovered area or any residue- Drinking Water Protection Overlay District Application DRC2008~00067~Hamilton Construction October 30, 2008 4 t, covered containers in uncovered areas should be cleaned up and documentation of the clean-up provided as part of DWP permit approval. Condition #4 Prior to occupancy ofthe new Fabrication Building (DRC2008-00060), a follow- up inspection to verify co~pliance with the listed conditions. Conclusions and Decision Based on the information provided by the applicant, and staff [mdings stemming from an analysis of the proposal for compliance with the standards found in Section 3.3-235 ofthe Springfield Development Code, the" Director concludes that the application is consistent with the stated . development standards and is thereby approved as.conditioned.
