'/ Ralph Nicholas Company 5335 Main Street #250 Springfield, OTegon 97477 Dear Mr. Nicholas: As a result of a recent inquiry relative to an offensive odor originating from the building located at 2020 I,lain Street, Springfield, Oregon, this office inspected the property from the exterior on June 7, 1982. It appears that the meat lockers/ storage area between the market and the secondhand store is the cause of the odor. Section 5-1-1 (3) (f) of the Springfield City Code prohibits ".. .premises which are , in such a state or condition as to cause an offensive odor or which are in an un- sanitary condition." Please refer to the attached copy of the Code. The meat lock- er/storage area must be restored to such condition so that it will not create an of- fensive odor. Since we were not able to view the interior, it is difficult to'des- cribe to you the appropriate corrective measures. However, odors of this type gen- erally reflect unsanitary conditions, therefore, a thorough cleaning with a strong disinfectant may solve the problem. This violation .must be corrected by ten (10) days from the date of this letter (July 3, 1982). Your anticipated courtesy and cooperation is appreciated. . Please direct all inquiries to the Springfield Building Division at 726-3753. S'l4~~ Sally Johnson Environmental Inspector cc: Joseph J. It is my understanding that the Science Christian of United Truth Church is the sponsor of this activity. If this is the case, then a church operated bingo game is an extension of the church, in the same way a Sunday school or nursery is an extension of a church. Churches and their related uses require a Special Use Permit before they may be established inside the City of Springfield (see Sections 3.04(12) and 4.04(36) of the springfield zoning Code). t 2. A bingo operation that is not affiliated with a church is not a specifically listed use in the Springfield Zoning Code. Section 4.04(137) is clear on what procedure to follow in such situations: "Additional uses similar in nature, size, bulk, parking coverage and traffic generation to those uses permitted in each particular district" shall be reviewed as ei ther a Special or Conditional Use. A regularly scheduled bingo operation is similar to uses that generate high traffic volumes at specific times: i.e. dance halls, auditoriums, civic, social and fraternal organizations. These uses require a Conditional Use Permit. t 3. Section 17.05 requires a Conditional Use Permit "...on those occasions when a particular use, not specifically permitted within a given district because of potential conflicts with permitted uses, wishes to locate in a district permitting that use". 225 North 5th Street · Springfield, Oregon 97477 . 503/726.3705 . There is no other legal and appropriate option than to require a Conditional Use Permit or Special Use Permit to permit expansion of area used for the bingojchurchjaudi torium operation. Our position is based on the unambiguous requirements of the Zoning Code. If you do not agree wi th our interpretation you may appeal this interpretation to the Planning Commission as specified in Section 1.06 (B) of the Springfield Zoning Code. If you have any questions or require additional information concerning the public hearing process please contact me at your convenience. Sincer~ ~ S.
