church operated bingo game is an extension of the church, in the same
way a Sunday school or nursery is an extension of a church. Churches
and their related uses require a Special Use Permit before they may be
established inside the City of Springfield (see Sections 3.114(12) and
4.114(36) of the Springfield Zoning Code).
'2. A bingo operation that is not affiliated with a church is not a
specifically listed use in the Springfield Zoning Code. Section
4.114(137) is clear on what procedure to follow in such situations:
"Additional uses similar in nature, size, bulk, parking coverage and
traffic generation to those uses permitted in each particular
district" shall be reviewed as either a Special or Conditional Use. A
regularly scheduled bingo operation is similar to uses that generate
high traffic volumes at specific times: i.e. dance halls, auditoriums,
C1V1C, social and fraternal organizations. These uses require, a
Conditional Use Permit.
3. Section 17.35 requires a Conditional Use Permit "...on those occasions
when a particular use, not specifically permitted, within a given
district because of potential conflicts with permitted uses, wishes to
locate in a district permitting that use".

There is no other legal and appropriate option than to require a
Conditional Use Permit or Special Use Permit to permit expansion of area
used for the bingo/church/auditorium operation. Our position is based on
the unambiguous requirements of the Zoning Code. If you do not agree with
our interpretation you may appeal this interpretation to the Planning
Commission as specified in Section 1.06(B) of the Springfield Zoning Code.
