ORDINANCE NO. 6024 (EMERGENCY) AN ORDINANCE AMENDING THE EAST MAIN REFINEMENT PLAN DIAGRAM AND PLAN DESIGNATION FROM MEDIUM DENSITY RESIDENTIAL TO COMMERCIAL! MIXED USE FOR PROPERTY KNOWN AS ASSESSOR MAP NUMBER 17-02-32-42, TAX LOT 2100,157 SOUTH 47TH STREET IN THE CITY OF SPRINGFIELD AND DECLARING AN EMERGENCY. WHEREAS, the proposed amendment was submitted in conformance with the provisions of the East Main Refinement Plan, Springfield Development Code Article 3, the Metropolitan Area Plan, and applicable state statutes and statewide goals; and WHEREAS, the Springfield Planning Commission conducted a public hearing on the proposed East Main Refinement Plan Diagram amendment on September 17,2002, and the testimony, findings, and conclusions of that meeting have been considered by the Common Council of the City of Springfield; and WHEREAS, the Springfield Common Council held a public hearing on October 7, 2002, on the proposed amendment; and WHEREAS, findings and testimony submitted by the applicant and those in support of this amendment satisfy the criteria of approval for the Refinement Plan amendments found in Section 8.030 of the Springfield Development Code; and WHEREAS, lawful notice of the amendment was published and posted; and WHEREAS, the Common Council met in Council Chambers, at 225 Fifth Street on Monday, the ih day of October 2002 at the hour of7:00 p.m., to hear any objections to the proposed amendment and---D....- persons appeared to object; NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS: Section 1: The Common Council finds that the legal notice of the hearing was lawfully published and posted; that ~ objections were made at the public hearing; that the public interest will not be impaired by the amendment of the East Main Refinement Plan Diagram, and that the amendment will be in the best interest of the public and increase the benefit of the property involved. Section 2: That portion of the East Main Refinement Plan Diagram as described in Exhibit A of this Ordinance is declared changed from Medium Density Residential to Commercial/ Mixed Use. Section 3: The findings adopted by the Common Council in support of this refinement plan amendment are hereby made part of the ordinance by reference. Section 4: The City Recorder is directed to file certified copies of this ordinance with the Lane County Clerk, Lane County Assessor, and Lane County Surveyor. Section 5: It is hereby found and determined that the matters relating to the East Main Refinement Plan Diagram are matters affecting the public health, safety and welfare, and that an emergency therefore exists, and this ordinance shall therefore take effect immediately upon its passage by the Council and approval by the Mayor. . . .
