In response to points raised in your letter, I offer the following comments: 1. I have discussed this issue with Associate Planner Bruce Newhouse and I am satisfied that he has an accurate understanding of the Code and it's application in this instance. 2. At the Development Review Committee Meeting on March 19, 1987, you were specifically informed that street trees needed to be planted along 19th Street. The Development Agreement signed by you on 6/12/87 and returned on 9/1/87, specifies in "AGREEMENT, point #1," that you would submit a Final Site Plan with "...all required modifications and applicable conditions." Your final site plan did not include the required street trees and you were so notified by Cindie Harmpn's letter dated 9/4/87. 3. In most situations, the vision clearance standard you cite in your letter would apply when designing a landscape' plan. Howeyer, because Main and South A Streets are one-way, the Code's vision clearance standard does not apply. The most persuasive argument in favor of your driveway variance was that the strict application of Code standards was not necessary because Main and South A Streets were one way. This agreement applies to both trees and driveways. 4. To address your sign visibility concern, we would suggest that you choose trees (from the recommended/acceptable list found'in Article 32) that do not have a wide crown, and selectively prune to keep them from significantly blocking the view of of your signs. Please refer to Cindie Harmon's letter of 9/4/87 for a summary of the required street trees: it is accurate. I b-1') Mct; 1\ kt 225 Fifth Street . I mention this because they are concerned that the City staff carry out the Council's policy to beautify the City. The landscaping that you have installed also has been noticed. Your efforts are commendable and will be an asset to the community. Thank you. Please let me know if you have further questions on this matter.
