ORDINANCE NO. 6019
(EMERGENCY)
AN ORDINANCE AMENDING APPENDIX 1, DEVELOPMENT CODE FEES,
OF THE SPRINGFIELD DEVELOPMENT CODE TO ADD A FEE FOR AN
"ACCESSORY DWELLING UNIT APPLICATION," AND DECLARING AN
EMERGENCY.
THE CITY COUNCIL OF THE CITY OF SPRINGFIELD FINDS THAT:

The Springfield Development Code (SDC) was adopted by the Springfield
City Council on May 5, 1986, and amendments thereto were subsequently
adopted by Ordinance.
A fee for an Accessory Dwelling Unit Application is necessary to recover the
costs of the application.
Findings in support of adoption of these amendments to the SDC are set forth
below:
3. The proposed fee is consistent with City Council policy to achieve full
recovery of the average cost of processing land use applications.
b. A comprehensive study of the average cost of processing land u~e
applications was conducted by the City in 1999 and the results of that
study have been updated by a cost of living increase (COLA) in 2000.
c. The fee increases are consistent with the facts of the fee recovery study
and reflect the true and average cost of processing such land use
applications.
Based on the above record of findings, the City Council concludes that the
SDC amendments are consistent with the Council policy on fee recovery for
city services.

Now, therefore, based on the above findings,
THE CITY OF SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOLLOWS:
Section I: Appendix 1, DEVELOPMENT CODE FEES ofthe Springfield
Development Code, is hereby amended the following fee:

Section 2: If any section, subsection, sentence, clause, phrase, or portion of this
ordinance is for any reason held invalid or unconstitutional by a court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision
and such holding shall not affect the validity of the remaining portions hereof.

Section 3: It is hereby found and determined that matters relating to the imposition of
Development Code Fees for an Accessory Dwelling Unit Application are matters
affecting the public health and welfare and that an emergency exists, and therefore this
Ordinance shall take effect upon adoption by the Council and approval by the Mayor.
ADOPTED by the Common Coundil of the City of Springfield by a vote of ~
