Condition #1: Concurrent with recording of the Final Plat, the'applicant shall execute and record Improvement Agreements against Parcels 1 and 2 for South 47th Street' improvements including paving, curb and gutter, sidewalk, storm sewer, and street lighting. Alternatively, the applicant shall provide satisfactory evidence that the existing Improvement Agreement obligations will automatically assign to both parcels upon recording of the partition plat. Applicant Response: The existing Improvement Agreement is included with this application highlighting the text that specifies the agreement pertains to all current and future parcels. Staff Finding: Satisfied. Applicant Response: The laterals have been installed and the building permit status report is included with this application. Staff Finding: Satisfied. Condition #3: Prior to approval of the Final Plat, the applicant shall install all underground utilities as depicted on' the tentative partition plan. Applicant Response: All utilities are or will be underground before submittal of mylars. Staff Finding: Partially Satisfied. Condition #4: The Final Plat shall dedicate a suitable private sanitary sewer easement against Parcell for the existing sanitary sewer lateral serving the dwelling on Tax Lot 6801. The final alignment of the easement shall be based on as-built information. as noted on the applicant's tentative plan. Applicant Response: The'easement has been shown on the plat and a separate easement document to be recorded has been included with this application. Staff Finding: Satisfied. Condition #5: The Final Plat shall provide for dedication of a variable-width private stormwater drainage easement across Parcell to accommodate the soakage trench as generally depicted on the applicant's tentative partition and easement detail plans. Applicant Response: The easement has been shown on the plat and a separate easement document to be recorded has been included with this application. Staff Finding: Satisfied. Condition #7: Prior to approval of the Final Plat, the 4-inch diameter stormwater drain pipe shall be stubbed to the Parcell building envelope area as generally depicted on the applicant's tentative plan. Applicant Response: The pipe has been installed and the building permit status report is included with this application. Staff Finding: Satisfied. Condition #8: Concurrent with recording of the Final Plat, the applicant shall record a deed restriction or similar mechanism against Parcell that obligates the property owner to construct an appropriate driveway crossing of the soakage trench. Applicant Response: A restriction note has been added to the plat and a separate document to be recorded is included with this application. Staff Finding: Satisfied. Condition #9: Prior to approval of the Final Plat, the applicant shall provide for relocation of the existing power pole from the northwest property corner..to another suitable location. Applicant Response: SUB has approved a new location for the power pole and relocation will occur before submittal of mylars. Staff Finding: Partially satisfied. The pole appears to have been relocated to the south, but overhead wires still extend to houses on Tax Lots 6801 and 6900. Condition #10: Prior to approval of the Final Plat, the applicant shall obtain a concurrence from the owner of Tax Lot 6801 agreeing to the utility relocation work as . depicted on the tentative partition plan. Applicant Response: A concurrence document is included with this application and a signed copy will be recorded before submittal of mylars. Staff Finding:. Partially satisfied. Condition #11: Prior to approval of the Final Plat, the existing overhead telecommunication lines serving the house on Tax Lot 6801 shall be relocated underground to a joint utility trench. Applicant Response: The overhead lines have been relocated underground as requested. Staff Finding: Not satisfied. Staff note that overhead lines still extend to the existing house on Tax Lot 6801. Condition #12: The Final Plat shall provide for dedication of a private utility easement across Parcell and benefiting Tax Lot 6801 to accommodate the joint utility trench as described on the applicant's tentative plan. . Condition #17: Prior to issuance of occupancy for the house on Parcel 2, the driveway approach serving Parcell, Parcel 2 and Tax Lot 6900 shall be constructed to City standards. The driveway has been constructed, and there is no need for a restriction note or separate document. '1 Planner: AL 5 of 7 Land Division Plat Application Process (see next page for a diagram of this process) 1. Applicant Submits a Land Division Plat Application for Pre-Submittal . The application must conform to the Land Division Plat Pre-Submittal Requirements Checklist on pages 5 & 6 of this application packet. . The purpose of pre-submittal is to ensure the applicant has all items necessary. for a complete submittal. . . A pre-submittal meeting to discuss completeness is mandatory. . Pre-submittal meetings are conducted every Tuesday and Friday, from 10:00am - noon. . We strive to conduct the pre-submittal meetings within five to seven working days of receiving the application. 2. Applicant and the City Conduct the Pre-Submittal Meeting . The applicant, owner, and design team are strongly encouraged to attend the pre- submittal meeting. . The meeting is held with representatives from Public Works Engineering and Transportation, Community Services (Building), Fire Marshall's office, and the Planning Division. . The meeting is scheduled for 30 to 60 minutes. . The Planner provides the applicant with a Pre-Submittal Checklist at the end of the meeting specifying the items required to make the application complete if it is not already complete. . . . The applicant will then have 180 days to make the application complete for submittal and acceptance by the City. 3. Applicant Submits a Complete Land Division Plat Application . When the applicant has addressed all items on the Pre"Submittal Checklist and the City Surveying Section has notified the applicant's surveyor that the plat and other documents are sufficiently refined, the applicant can submit a complete application to the City Survey Section located in the NW Quad of City Hall. . The application must conform to the Land Division Plat Submittal Requirements Checklist on page 6 of this application packet. . If the submittal is deemed complete, the City Survey Section will sign-off on the City Survey approval sheet and send the applicant to the Development Services Department for application submittal and fee collection. . Planning staff checks and signs the mylars. 4. Applicant Records Plat at Lane County & Submits Plat and Documents to City . j,\fter Planning staff checks and signs the mylars, the plat may then be recorded by the applicant's surveyor .at Lane 'County. . . After plat has been recorded at Lane County, applicant submits five (5) recorded, rolled paper copies of the plat and three (3) copies of required documents to the Development Services Department prior to the issuance of building permits. City Surveyor conducts field check and returns comments to applicant's surveyor ~ / Applicant's surveyor sets new monuments and flags existing ones. 1 Once no errors appear on the plat and a current title report is submitted, applicant's surveyor is given ok to submit complete land division plat application. 1 After ok given from City Surveyor and applicant has addressed all incomplete items from _ pre-submittal, applicant submits complete application to the City Survey Section (See Land Division Plat Submittal Requirements Checklist) 1 City Survey Section signs-off on City Survey approval sheet and sends the applicant to the Development Services Department for application submittal and fee collection. 1 Planning staff checks and signs mylars and notifies applicant's surveyor of approvaL 1 Applicant takes plat and accompanying documents to Lane County for recording. 1 Applicant brings copies of recorded plat and documents to Development Services Department.
