NOTE: If you feel an item does not apply, please state the reason why and attach the
explanation to this form.

Application Fee - refer to the Development Code Fee Schedule for the appropriate fee
calculation formula. A copy of the fee schedule is available at the Development Services
Department. Any applicable application, technology, and postage fees, are collected at
the pre-submittal and submittal stages.
Land Division Plat Application Form
Letter Addressing Conditions of Approval - lists and addresses each condition of
approval, detailing the actions taken and current status of each item.
Nine (9) Paper Copies of the Plat stamped and signed by the surveyor.
Two (2) Copies of Closure Sheets for the boundary and each lot or parcel and all
common areas, dedicated areas, and easement areas that are not simple parallel offsets.
Two (2) Copies of Title Report or Subdivision Guarantee for the parcel being
divided. The title report must be dated within 30 days of submittal at the time of the final
submittal. An older report is OK at the pre-submittal stage.
Two (2) Copies of Each' of the Reference Documents and Plats listed on the plat.
Two (2) Copies of Each of the Supporting'Documents - the vesting deed (must vest
. title to the owner listed on the plat), existing easement deeds, and documents listed as
exceptions in the title report, etc.
Two (2) Draft Copies of any street dedications.
Two (2) Draft Copies of Any New Easements or Restrictions being created by
separate document, improvement agreements, maintenance agreements, joint use
ingress/egress and utility easements, sewer hook up in lieu of assessment, and any other
documents that will be recorded together with the plat or that are required by the
Conditions of Approval.
Two (2) Copies of a Consent Statement (Concurrence) on the plat (to be signed by
the lender prior to final approval) OR Two (2) Copi~s of an Affidavit of Consent by
separate document is required from all Trust Deed, mortgage, or other secured loan
interest holders against the property to be recorded simultaneously with the plat IF any
public dedications or easements are being made and/or any other interests are being
transferred to the public per ORS 92.075 (2-4). '
Copies of Wetland Documents as required.
Copies of ODOT Access Permits as required.
Draft Copy of Bargain and Sale Deed for Reserve Strips - City Survey Section has a

WRITTEN STATEMENT
FOR THE FINAL PARTITION PLAT ApPLlCA nON
This application is a submittal of the final partition plat for the property located at 441
South 47th Street The partition was granted conditional approval on October 13,2008 W1der
Case Number SUB2008-00040,
The following is a discussion of how the final plat conforms to the conditions of approval
placed on the tentative partition application:
I) Concurrent with recording of the Final Plat, the applicant shall execute and record
Improvement Agreements against Parcels I and 2 for South 47th Street improvements
including paving, curb and gutter, sidewalk, storm sewer, and street lighting,
Alternatively, the applicant shall provide satisfactory evidence that the existing
Improvement Agreement obligations will automatically assign to both parcels upon .
recording of the partition plat
The existing Improvement Agreement is included with this application highlighting the
text that specifies the agreement pertains to all current and future parcels,
2) The sanitary sewer laterals installed to serve Parcels I and 2 shall be at least 4 inches in
diameter in accordance with City specifications,
The laterals have been installed and the building permit status report is included with
this application.
3) Prior to approval of the Final Plat, the applicant shall install all W1derground utilities as
depicted on the tentative partition plan,
All utilities are or will be underground before submittal of mylars,
4) The Final Plat shall dedicate a suitable private sanitary sewer easement against Parcel I
for the existing sanitary sewer lateral serving the dwelling on Tax Lot 680 I, The final
alignment of the easement shall be based on as-built information as noted on the
applicant's tentative plan.
The easement has been shown on the plat and a separate easement document to be
recorded has been included with this application.
5) The Final Plat shall provide for dedication of a variable-width private stormwater
drainage easement across Parcel I to accommodate the soakage trench as generally
depicted on the applicant's tentative partition and easement detail plans,

6) Prior to approval of the Final Plat, the stormwater drainage pipe and soakage trench
serving Parcels I and 2 shall be installed and functioning as generally depicted on the
applicant's tentative plan.
The pipe and trench have been installed and the building permit status report is included
with this application.

7) Prior to approval ofthe Final Plat, the 4-inch diameter stormwater drain pipe shall be
stubbed to the Parcell building envelope area as generally depicted on the applicant's
tentative plan,
The pipe has been installed and the building permit status report is included with this
application.
8) Concurrent with recording of the Final Plat, the applicant shall record a deed restriction
or similar mechanism against Parcel I that obligates the property owner to construct an
appropriate driveway crossing of the soakage trench,
A restriction note has been added to the plat and a separate documenlto be recorded is
included with this application.
9) Prior to approval of the Final Plat, the applicant shall provide for relocation of the
existing power pole from the northwest property comer to another suitable location,
SUB has approved a new location for the power pole and relocation will occur before
submillal of mylars,
10) Prior to approval of the Final Plat, the applicant shall obtain a concurrence from the
owner of Tax Lot 6801 agreeing to the utility relocation work as depicted on the tentative
partition plan,
A concurrence document is included with this application and a signed copy will be"
recorded before submillal of my lars,
11) Prior to approval of the Final Plat, the existing overhead telecommunication lines serving
the house on Tax Lot 6801 shall be relocated undergrouI)d to ajoint utility trench,
The overhead lines have been relocated underground as requested.
12) The Final Plat shall provide for dedication of a private utility easement across Parcel I
benefiting Tax Lot 680 I to accommodate the joint utility trench as described on the
applicant's tentative plan,
At this time, the location of the sewer facilities is to remain in its current location and an
appropriate easement has been shown on the plat as stated in Condition 4,

13) The Final Plat shall provide for dedication of a private utility easement across Parcell to
accommodate the soakage trench as generally depicted on the applicant's tentative
partition and easement detail plans,

14) Prior to approval of the Final Plat, the applicant shall install "No Parking - Fire Lane"
signage along the panhandle driveway in accordance With SFC requirements,

15) The Final Plat shall provide for dedication of a variable-width private access easement
and maintenance agreement against Parcel I for the benefit of Parcel 2 as generally
depicted on the applicant's tentative plan, '
The easement has been shown on the plat and a separate easement document to be
recorded has been included with this application.
16) Prior to-issuance of Final Occupancy for a dwelling on Parcel l, at least two paved off-
street parking spaces shall be developed on the site,
A restriction note has been added to the plat anda separate document'to be recorded is
included with this application.
17) Prior to issuance of occupancy for the house on Parcel 2, the driveway approach serving
Parcell, Parcel 2 and Tax Lot 6900 shall be constructed to City standards,

18) The applicant shall provide and maintain adequate vision clearance triangles at the
comers of the site driveway in accordance with SDC 4.2-130,

IMPROVEMENT AGREEMENT
INCLUDING NOTICE OF POTENTIAL ASSESSMENT LIEN

IN CONSIDERATION of the covenants herein recited, the City of Springfield, hereinafter
referred to as City, and Garth B, White and Dannika D, White
hereinafter referred to as Applicant(s), do covenant and agree, with respect to the rea!'
property described below as follows:
1, Applicant(s) warrants and represents to the City of Springfield .that it is the owner of
the property more particularly described and set forth in Paragraph 7 below and, as
owner, has the authority to enter into this Improvement Agreement with the City of.

3, The development will cause both an immediate and long-term demand on the various
public facilities of City and Lane County including the specific public improvements

4, This Improvement Agreement is an alternative to imposing a condition on Applicant's
development approval that the Applicant make immediate construction of any public
improvement that the development necessitates. The objective is to promote
efficiency, coordination, and spread costs by providing an opportunity for a district
wide improvement mechanism where construction occurs. in a coordinated project
with the participation of adjacent and other properties in the area, instead of requiring
immediate improvement in conjunction with each development application. There is
no guarantee, however, that such a coordinated project will be possible and the City
reserves the right to require construction of the improvements in the future at City
discretion,
5, (a) Applicant and City agree that Applicant will pay the cost of the following public
facility improvements described in Paragraph 6 in accordance with respective cost
assumption policy established by City at the time the City determines to undertake
and complete such public improvements,
(b) Applicant and City acknowledge and agree that the cost of such improvements
and the portion thereof to be paid by Applicant are presently unknown and may be
greater than the costs, that would be apportioned if the improvements were
constructed immediately or by Applicant now or later.

said easement lies in Parcell for private storm drainage and storm trench purposes,
E) Exclusion ofPUEs: Notwithstanding any other language herein, these easements do not
allow the placement ,of private utilities within any Public Utility Easement except for
crossings,
F) Use of the Burdened Pronertv: The owners or occupiers of the parcels affected by
these easements shall have the right to use their property, including the areas described as the
easements, for any purpose as long as the owners or occupiers do not interfere with the use of
the easements as granted by this instrument. No vehicle parking or storage of vehicles shall
be allowed by any party within the access easement area, including the agents, employees,
tenants, and invitees of said owners,
G) Maintenance and Renairs: The cost of any maintenance or repair of the driveway within
the easement area shall be split equally between the owners of Parcels I and 2, The cost of
any maintenance or repair of private utilities lying within' the easement areas will be th~
responsibility of the owner of the respective facility, The cost of any maintenance or repair
of the shared private utilities and/or the shared storm drainage system lying within the
easement areas will be split equally between the owners of the parcels using the shared
facility, '
H) Successors in Interest: The provisions of this instrument touch and concern, and relate
to the use of Parcels I and 2 of said partition, and are intended to be covenants and
restrictions running with the land, All provisions of this instrument, including the benefits

The true and actual consideration for this declaration is other than monetary,
RECITALS:
1) DAVID M, NOWAK, Grantor, is the owner of Parcel 2 of Land Partition Plat Number
2007-P2141 as partitioned and recorded June 29, 2007 in the Land Partition Plat Records of
Lane County, State of Oregon,
2) TAWNY A R. PRATT, Grantee, is the owner of Parcel 1 of Land Partition Plat Number
2007-P2141 as partitioned and recorded June 29, 2007 in the Land Partition Plat Records of
Lane County, State of Oregon,
3) The Grantees have an existing sanitary sewer lateral from their home on said Parcel I that
crosses a portion of the land of the Grantor.
4) The grantor is dividing his lands into two parcels as shown on Land Partition Plat No, 20_-
P as partitioned and recorded _, 20_ in the
Land Partition Plat Records of Lane County, State of Oregon,
!j) As a condition for approval of said partition by the City of Springfield, the Grantor desires to
create an easement to cover the existing sanitary lateral that benefits the lands of the
Grantees that crosses a portion of Grantor's lands,
THEREFORE:
DAVID M. NOWAK, Grantor, hereby grants, transfers and conveys to TAWNY A R. PRATT,
Grantee, a perpetual, non-exclusive, appurtenant easement for private sanitary sewer lateral
purposes and maintenance thereof over and under that certain area designated as "5,00' WIDE
PRIVATE SANITARY EASEMENT" on said partition plat (LPPN 20_-P ) as said
easement crosses the northerly portion of the panhandle section of Parcel 1 of said partition plat
SUBJECT TO THE FOLLOWING:
I) The intent of this document is to create an easement that covers the existing lateraL
Should the lateral be found not to lie within the described easement, the centerline of this
easement shaH adjust automaticaHy so as to foHow the centerline of said lateraL
2) Costs for maintenance and repair of the private sanitary sewer shall be the responsibility
of the Grantees,
3) Upon completion of any maintenance or repair, the Grantees shaH return the disturbed
area to its condition that existed prior to said work.
4) Grantor shall at all times, and without restriction, have the right to use the easement area
for purposes not inconsistent with the purpose ofthe easement
5) This easement is noqiersonal or in gross, but is appurtenant to each and every portion of
the lands of the Grantee.
