RE: REFERRAL FOR PROSECUTION, CHET'S AUTO REPAIR SERVICE
Please find enclosed for your information and file copies of
the following documents:
1. Letter dated January 17, 1983, to Chet's Auto
Repair Service from this office informing the
proprietor, Chet Wagers, of a violation of
Section 504(A) and Table 5-A of the Oregon State
Structural Specialty Code and Fire and Life
Safety Code.

2. Letter dated January 27, 1983, from Walter S.
Bristow, III, attorney for Chet Wagers.
3. Letter dated March 15, 1983, to Mr. Bristow
from this office.
Please be informed that Mr. Wagers has taken no action,to remove
the windows installed in the east wall and to return the wall
to its original construction.
The building as modified by ~~. Wagers is now in violation of
the Oregon Structural Specialty Code and Fire and Life Safety
""Gods, Section 504(A) and Table 5-A.

Please institute an action in the Municipal Court of the City
of Springfield to compel compliance by Mr. Wagers with the
applicable codes.
Your attention is drawn to Section 1-12-7 of the Municipal Code
which provides in pertinent part that violation of a code
adopted by the city "shall be punished by a fine not exceeding
$500.00, or imprisonment for a term not exceeding 100 days,
or both such fine and imprisonment".
Your attention is further directed to the provisions of subsection
(2) of that section which provides that "every day any violation
of this code or other ordinance of the city shall continue shall
constitute a separate offense."
As a matter of courtesy, I am providing a copy of this referral

Dear Sir:
On September 3, 1982 we noticed windows had been installed in the concrete block
wall 'on the east side of your building. Said building is located at 3816 Main
Street, Assessors Map 17-02-31-42, Tax Lot #1100.
Our records indicate the lot is 57 feet wide by 150 feet deep, and appears the east
wall of the building is on or within a foot or two of the east property line, 'thus
requiring the east wall to be of 4 hour fire resistive construction, with no open-
i ng penni tted.
Please accept this letter as a notice to remove the windows installed in the east
wall and return the wall to its, original construction within 30 days of receipt of
this letter. Notify the Springfield Building Division when the work is complete.
A building permit must be obtained before starting any work on a commercial building
and all work must be inspected for compliance to applicable codes.
For further information, please call the Springfield Building Division at 726-3753.
