Welt 290 Palmer Ave Cottage Grove, Or 97494 *,...... , . .,' Subject: Minimum Development Standards requirements for proposed expansion at 3760 Main Street which will add a pick.up window to Giant Burger and expand the building footprint with a 12' x 22' addition. Dear Mr. Welt: The Springfield Development Code (SDC) 31.010 requires any business that has changed use or expanded by no more than fifty percent or 10,000 square feet to be reviewed for Minimum Development Standards (MDS). These standards help establishments comply with new development standards without the cost and time required for a full site plan review. Your proposal to expand your current business to approximately 1,288 square feet requires an MDS review, The following conditions must be met at 3760 Main Street to successfully complete the MDS process: V Street Trees: The two trees planted along Main Street meet minimum code requirements. The applicant must consider the following code requirements to determine if additional street tree placement along 38th Street is required. SDC 32,050(2) requires that 2 inch caliper trees, selected from the City's street tree list shall be spaced at 30 foot intervals along street property line. The applicant's plan does not show the distance from the third driveway to the northern property line. Street trees shall not be planted closer than 35 feet from the perpendicular curb line of intersections of streets and 10 feet from driveways. /' Sidewalks: The existing sidewalks on Main Street meet minimum code requirements. The sidewalk on 38th Street is existing non-confonning use. There is no sidewalk between the restaurant building and the street. Staff recommends that the applicant plant the non-confonning strip along the east side of the restaurant building, as well as extend the decorative wrought iron or masonry fencing which the applicant has proposed to use along the 38th Street frontage. /' Required landscaping: The landscape strip along the frontage of Main Street must be a minimum of 5 feet in width and planted with plant materials which will cover at least 65% of the required planting area within 5 years of the date of installation. Except where planted with drought resistant materials, all planted area must be irrigated. SDC 3 1.0 I 0(2)(c) states: "Where there is no room for a landscaped strip due to existing structures, paved parking. . .decorative fencing (e.g., wrought iron or masonry) subject to the height and vision clearance setbacks of Section 18.100 (2 1/2 foot vision clearance) may be located directly behind the property line. . . in lieu of the landscape strip. . ." Staff recommends that the applicant place a decorative fence along the entire length ofthe eastern property line beginning at Main Street and running north along the 38th Street frontage; or, provide a five-foot.wide landscaped planter strip with approved irrigation or approved drought resistant plants between the sidewalk (property line) and the parking areas or structures. V' Parking lot paving: All customer parking areas must be paved with a durable dust free surface which includes asphalt concrete or Portland cement. If the value of the paving exceeds $10,000 the project may be completed within a 3- year time period providing a bond or security deposit is provided for the value of the paving. The 1,024 square-foot restaurant requires 13 paved parking spaces. The residential dwelling (existing, non-confonning use) requires an additional 2 parking spaces, for a total of 15 spaces. ... / . . All parking must be paved, stripped and provided with wheel stops. The unimproved area toward the rear of the lot must be barricaded from parking use or it must be paved. Connections to stonn sewers and drainage must meet City code. There is a stonn drain in the parking lot which is not working properly due to uneven elevations in the current paving; parking lot drainage must meet city code. V An unsafe curb cut: The applicant has agreed to pennanently close the first driveway along 38th Street. This will require some cement work to remove the curb cut and replace the sidewalk. v'" All trash receptacles must be screened from public view. v'" Connection to stonn sewer lines: All parking lot drainage must meet City Code, (see attachment) .1L' Minimum 10' setback from side property line. Furthennore, the applicant has agreed to provide at the minimum a two-car-cueing drive-up to the proposed pick.up window. The applicant has stated that the use of the window is for pick-up orders, not for drive-in orders. All of the above improvements must be completed within a 90 day time period from the date of this letter or a bond or security deposit must be posted for this work. An estimate of the cost to install these improvements must be provided. Please contact a bank or bonding company for establishment of security if the improvements are deferred.
