Prior to approval of the Final Plat, the developer shaH instaH street trees and a 5-foot wide sidewalk along the public street frontage ofthe site in accordance with SDC 32.020 and the City's EDSPM. Applicant's Response: The street trees will be bondedfor prior to Final Plat approval. Staff response: " Condition met. 2. Prior to approval of the Final Plat, the developer shaH submit supplement>ll stormwater design information and supporting documentation prepared by the Engineer of record: The supplementary information shaH demonstrate compliance with stormwater capacity requirements and show a specific design for the new subdivision area. Applicant's Response: All of the stormwater "calculations have been submitted and approved as a part of Phase 4. The Final Plat shaH provide for dedication of an additional IO-foot wide PUE along the western boundary of Lot 1, for a total PUE width of 20 feet as depicted on the tentative plan. The Final Plat shaH provide for dedication of a blanket public access and trail easement across Tract A until a replacement easement acceptable to WiHamalane Park and Recreation District can be prepared and recorded based on trail as-built information. Prior to recording the Private Conservation Easements affecting Lots 1-16, 3.6, 37 and 53 of the subdivision plat, the developer shaH provide a copy of the document for review and approval by the City. Prior to approval of the Final Plat and recording of the Covenants, Conditions and Restrictions document affecting Lots 1-53 and Tract A, the City shaH review and approve the CC&R document. The CC&R document for the cluster subdivision shaH detail and make appropriate provisions for the ongoing maintenance of the joint use private streets and streetside sidewalks serving the development area. Applicant's Response: The CC&R's will be submitled with the Final Plat for review. Staff Response: " Condition met - staff are reviewing draft CC&Rs and will provide comments. 15. Prior to approval of the Final Plat, the IS-foot wide Private Conservation Easements depicted on the tentative plan shaH be recorded and evidence thereof provided to the City. ' Applicant's Response: The 15-foot wide easement will be shown and dedicated on the Final Plat. Staff Response: " Condition met. Easement shall be dedicated as a "landscape conservation easement". 16. Prior to approval of the Final Plat, a Final Site Plan shall be-approved for the subject site through the City's Site Plan Review application process. The approved Final Site Plan development configuration shaH be consistent with the lot layout depicted on the Final Plat. At a minimum, the developer shall meetthe requirements of the Development Code in effect at the time of Master Plan approval (1998). Applicant's Response: A Final Site Plan will be submitled during the Final Plat review. Staff Response: "Condition not met. Final Site Plan submittal is incomplete. 17. Prior to approval of the Final Plat, the-developer shall provide copies of the Public Access Easement documents for review and approval by the City and WiIlamalan,e. . Draft easement document not submitted for staff review. 18. The access and trail head path easements shaH be recorded on the Final Plat as Public Access Easements. The paving and grading plan submitted for the Cluster Development Site Plan Review shaH provide details on the crosswalks and sidewalk connections along the north sides of Lots 29 and '44. Pri~r to approval of the Final Plat, the developer shaH revise the paving 'and grading plan to include wheelchair ramps at the ends of the sidewalk segments on Lots 35 & 36; and on Lots 38 & 39. Applicant's Response: The width of lots 35, 36, 38 and 39 is such that the driveway will encumber the entire width of the lots. The wheelchair ramps will be incorporated into the driveways. In accordance with the Mountaingate MaSter Plan approval, prior to issuance of City penn its for any construction activity on the site the developer, the consulting Forester and the City shall conduct a site visit to determine if any mature, viable Oregon White Oak trees exist on the site and to make appropriate provisions for protecting these trees. Applicant's Response: The Site visit was performed by Doug Wolf and Jim Donovan prior to the construction of Mountaingate Drive. Staff Response: "Condition not met. The development area was not specifically evaluated during the previous site visit. A coordinated inspection will be scheduled in conjunction with the required Tree Felling permit. Prior to approval of the final Plat, the developer shall submit supplemental stormwater design information and supporting documentation prepared by the Engineer of record.
