An inspection of the Mountaingate North Cluster model home site was conducted yesterday, 6 May 200'1 and it was found that the contractor was working outside of the established limits of disturbance agreed upon under.the approved LDAP, The grading appears to have impacted a cluster of trees to the southeast of the utility vault that was installed earlier this week, and'although the trees are within future right of way and are slated for removal, approvals and permits for work in this area have yet to be issued, During the initial on-site meeting, all parties verbally agreed that orange construction.fence would be.used to delineate the approved limits of disturbance and that grading activity would be limited to the excavation of the building pad; furthermore, work related to the PIP was restricted to the extension of public utilities and the installation of two manholes. The grading activity that took place yesterday was not only well outside the approved limits of LDAP or public improvement scope of work, but it was also clear that the orange construction fence - fence placed to inhibit equipment access - was removed by the contractor to allow equipment into this area. If this project is going to continue prior to public improvement and land use approvals, care must be taken to remain within the acceptable limits of the approved LDAP, and if these limits need to be more stringently defined then we will do so as necessary. If work outside of the approved LDAP limits of disturbance continues, the permit will be suspended per Springfield Municipal Code section 8.330(c) and will not be reinstated until all approvals related to land use and public improvements are granted. To remediate the current situation, the disturbed ground must be stabilized by the end of the day, Friday, May 8. A suitable soil coverage medium will be required over all exposed soil and all construction fencing shall be replaced along all trees that are to remain. Attached is the letter that was sent to Tim with copies also going to Mark Vukanovich and Seth Brown at Kipco. The long and short of it is, if they perform anymore work outside of the scope of the LDAP prior to obtaining the PIP and Planning approvals/permits, I will suspend the LDAP and posta stop work order effective until such approvals are obtained.
