Those, trees were removed during approved LDAP grading and the remainder of the trees were required to be isolated from the approved working area with orange construction fence. While Ben and I were on the site today, we noticed that the orange fence was removed and that the excavator was working within several feet of trees that were not approved for removal; furthermore, the excavator was also performing grading activity that is outside of the approved LDAP limits and without PIP approvals. Although no additional trees were removed, several were visibly damaged by today's grading activity and the root zones are likely impacted as' soil was pushed and compacted around the base of the trees. Granted, the location of the trees is within a future street related to the PIP, the contractor does not have the necessary approvals or permits to be 'performing this work yet. I told them that they needed to move the equipment away from the trees immediately and that any damage or removal of the trees may require a corrective tree felling permit. Planning was not apprised of any required tree cutting to facilitate this work. Based on the density of trees on the periphery, it' appears that more than S trees greater than 5" diameter were probably re~oved from the site. ,In addition to an LDAP, this work probably warranted a separate tree felling permit - although by now we don't have conclusive evidence of how many qualifying trees:were removed. In a conversation with the contractor this morning, I discussed with the contractor work to be completed for the installation of SUB's Electric vault and conduit. In impacting this area, the grading and exposure of the soil to the current weather was not discussed and has now created an erosion concern that will need to be addressed. A perimeter fence was also removed to permit the access of equipment into areas where there was not to be any surface disturbance to soil or trees. Please provide comments to Matt and Todd so that the contractor might receive direction to address erosion issues that have been created, and make clear the City's direction to permit future site work.
