Andy stated that the lack of names on the private streets was as the developer had proposed, and being that there is no specific condition requiring private streets in a cluster development and that the Development Services Department, developer, and our addressing folks were OK with having all lots be addressed on Mountaingate Drive, it was apJroved. It wasn't much of an addressing issue because it was to be addressed in the same way apartments or condos a~e done. The developer had proposed names at the beginning of the Mountaingate project, but Andy did say that the names they had first proposed did not meet the road naming standards. The developer's next submittal did not have road names. I did take a quick look at the ORS, and didn't find anything on "cluster -type developments". In Ch. 92 the definition of road or street is: (92.010) (14) "Road" or "street" means a public or private way that is created to provide ingress or egress for persons to one or more lots, parcels, areas or tracts of land, excluding a private way that is created to provide ingress or egress to such land in conjunction with the use of such land for forestry, mining or agricultural purposes. Also, 92.0S0(4){d) does state "Each street is named and shown on the plat." . I think it looks like this is one of those sticky situations where it is not absolutely clear what defines a "road or street", but I would think that labeling an area a "Street" etc. would define it as such. On the Cottage Collection plat, the areas are not labeled as "roads" or "streets", just as a "private access (etc) easement". Essentially, to me, it seems the same as a "private access easement" as would be shown on many partition plats. Also I just took a look at some other "Cluster" subdivisions on the County site and it looks like there are clusters both ways, some with names on the'accesses (Fox Pines, Aubrey Farm), and others without named accesses (Kendra Park Cluster, Jason Cluster, Lorane Cluster, East Campus Cluster). But, overall I hope this should suffice for an explanation, and I think enough people understand the addressing agreements that there shouldn't be an issue later.
