RE: UNITED TOOL - TRANSIENT AND ELECTRICAL MERCHANT LICENSES
Dear Mr. Smith:
Thank you for stopping by the Finance Department to inquire about which
business licenses are required in order for you to operate your tool
vending business in Springfield.
As I understand your business operation, you are required to obtain the
following licenses:
Transient Merchant
'Electrical Merchandise
City Code Section 8-2-6(9)
City Code Section 8-2-8
$30 per day
$25 per year
According to our conversation last week, you sell new tools and other
miscellaneous items (sunglasses, car stereos, electrical products) at
57th and Main Street from your truck/tractor vehicle on weekends.
Section 8-2-6 of the City Code states: "'Transient Merchant' shall mean
any person engaged in the business of selling goods or services from a
booth, cart, wagon, vehicle or device of any other type, or building
upon any private property, when such person is not regularly engaged in
a permanently established business of selling said goods or services
in the city. Any merchant regularly engaged in the vending of food,
ice cream, beverages and refreshments having obtained a permit from
the city shall not be considered a "transient merchant" under this
section."
Based on the fact that you operate in Springfield only two days per
week and routinely operate from place to place in other cities,
I do not feel you qualify as a "permanently established business."
Please obtain the above listed licenses from our office by Friday,
June 27, 1986. In order for the City to grant approval of the Transient
Merchant License, we need written permission for your operation from
the property owner. Additionally, the Planning Department has indicated
that use of a parking lot intended for customer parking for this purpose
will not be recommended for approval.
