The following items were discussed and have not been resolved at this time: 1. A complete site plan must be submitted for review, which includes the minimum information required as outlined in the handout submitted to the applicant. 2. The following requirements of the CUP, dated 10-5-77, have not been met and must be addressed before a site plan can be approved: a) Off street parking for customers must be provided on the property. The applicant stated he may appeal this requirement. b) Installation of sidewalks along Main Street is required. The applicant indicated that the t3roperty facing north toward Main Street was being fenced and should be completed within 30 days. On the remainder of the property he could see no reason for fencing and intended to ask for a variance to that requirement. d) Signing of a Street Light Agreement, This would . be required by the property owner to be valid, and I am not sure if he even knows it is required. .Mr. Frey is sub-leasing the property from the primary leasee who is leasing the property from the owner, George Wi ngard. ;4 .... Don Branch was present to represent this request and asked if the full improvement of South 57th Street, 'as required in condition 'c', meant a 2/3 improvement, Dick Johnson explained that the developers would have to have full improvements on their side of the street, including curbs, gutters, sidewalks, and paving, MOTION: It was moved by Rob Adams and seconded by Nelson Grubbe to grant approval to this request subject to conditions 'a' through 'd' in the Staff Report. The conditions are as follows: a. A site plan is required as lots 1 through 5 are under an ROI to be rezoned to R-2. All conditions of the ROI must be met. b. Dedication of right-of-way to 30 feet from the centerline on South 57th Street. c. Full improvement of South 57th Street, including curbs, gutters, sidewalks, street lights, storm sewers, and sanitary sewers. d. Fully engineered drawings are to be submitted and approved before the subdivision will be given final approval by the City. The motion was approved unanimously. 5. CONDITIONAL USE PERMIT Frederick'R: Frey (Journal No. S-77-76) Continued from June Located at 3001 Main Street on the southeast corner of the Southern Pacific Rail- r road and Main Street. The CUP was approved in October of 1977 and requires a complete \-. site plan to be submitted within six months. Over six months have passed and a site plan has not been submitted, although a fence is now under construction. A review of the CUP is needed. There was no one present to represent this request. Dick Johnson noted that the Planning Commission had received a copy of a letter sent to the applicant by Sally Johnson of the Building Division. He noted that construction of the fence had al- ready been started. Melvin Suit commented that he thought the fence had already been constructed, but that it "didn't look good from Main Street." Mr. Johnson added that no site plan had been presented. A short discussion of the CUP continued. , / Julio Iturreria stated that he had talked to the applicant, who explained that he wasn't aware of the requirements he had to follow, but would be willing to submit a site plan. Mr. Johnson suggested that the Planning Commission direct the Staff to send a letter to Frederick Frey and have the Site Plan Review Board talk to him about his plans. MOTION: It was moved by Rob Adams and seconded by Nelson Grubbe ,to grant a one~ ,month extension 6f this CUP in order to give the applicant time to work with the Staff. 'The Staff is directed to inform Frederick Frey that he has a one-month extension and that unless he meets with the Site Plan Review Board and presents a suitable site plan, the CUP will be allowed to expire. The motion was approved unanimously. This property has a conditional use permit which was granted in March, 1977, to allow a wood and cabinet shop in an old building in the C-4 District after making proper modification of the building. The building has been condemned and the CUP should thus be allowed to expire. The CUP was allowed to expire. Frederick R. Frey (Journal No. S-77-76) , Located at 3001 Main Street on the southeast corner of the Southern Pacific Rail- road and Main Street. The CUP was approved in October of 1977 and requires a complete site plan to be submitted within six months. Dick Johnson stated that Mr. Frey had called him and explained that he was having some problems with his property which delayed the site plan submittal. P. No. 694) Located at 510 39th Street. Would create two lots with Lot A, a panhandle lot containing approximately 7,300 square feet, and Lot B, containing approximately 5,300 square feet. The Land Development Review Committee approved this request on April 20, 1978 with the condition that dedication of right-of-way to,30 feet from the centerline be made on 39th Street. The applicant is appealing this condition. Dick Johnson read a letter from the applicant in which he explained his reasons for appealing the decision set by the Land Development Review Committee. A short discussion of this request took place among the Planning Commission mem- bers and Staff. MOTION: It was moved by Rob Adams and seconded by Melvin Suit to deny this appeal. The motion was approved unanimously. Dick Johnson announced that the streets in the Valley East Subdivision had not been named properly.
