Dear Mr. Wingard:
It is our 'understanding that you are the legal owner of property located 'at'3001 .
Main Street in Springfield, Oregon (Assessor's Map 17 02 31 Tax Lot 600). It is our
further understanding that this property, which is zoned M-3 Heavy Industrial District,
is being leased to Mr~ Frederick Frey for the operation'of an auto-towing service.
The Springfield Planning Commission gave approval in October of 1977 for a Con-
ditional Use Permit (CUP) for Mr. Frey to operate the auto-towing service on your
Main Street property noted above. Approval of the CUP was subject to a number of
conditions set by the Planning Commission which had to be met for the auto-towing
operation to occur on the property.
The conditions of the CUP have not been met. Thus, on August 30, 1978, the Spring-
field Planning Commission reaffirmed and slightly modified the conditions of the CUP.
Mr. Frey disagreed with the CUP conditions set by the Planning Commission and thus ap-
pealed the Planning Commission's decision to the Springfield City Council. The Spring-
field City Council heard Mr. Frey's appeal on September 18, 1978, and requested that
this letter be sent to you as the owner of the property, since the consensus of the
City Council was that you, as the property owner, rather than Mr. Frey, as the Lessee,
should be required to meet the conditions of the CUP.
The conditions of the CUP, as set on August 30, 1978, which are to be met, are
hereby listed for your information:
.a. Off-street parking for customers must be provided on the property, with an oil mat.
b. Installation of sidewalks alo~g Main Street is required. Applicant has a time
limit of one year to install the sidewalks.
c. Installation of a slatted cyclone fence with shrubbery along Main Street, with
fencing as required by ordinance along the remainder of the property. Applicant
must have this condition completed by the'end of calendar year 1978. '
d. Signing of a street light agreement. Applicant has a period of 30 days to sign
the agreement.

CORRESPONDENCE AND PETITIONS
1. Correspondence from r.lr. and Mrs. W. R. Campbell Jr. - Appeal of
Planning Commission Denial of Minor Partition. It was moved by Mr. Davis,
with a second from Mr. Adams, to accept and file the communication and to set
an informal public hearing for October 2, 1978. The motion passed
unanimously.
2. Correspondence from Frederick R. Frey - Appeal of Planninq Commission
Requirements on Conditional Use Permit. Mayor Meyer requested that the staff
present their report on this matter. City Planner Dick Johnson presented to
the Mayor and Council the staff report on the Frey appeal of the Planning
Commission requirements' for conditional use permit. Mr. Hulett ~uggested that
the City correspond with .the owner of the property and get his response to
the conditions set for the conditional use permit. Mr. Hulett felt that the
City should wait until they heard from Senator Wingard before taking action
on this matter. Mr. Frey, 3001 Main Street, addressed the Mayor and Council
stating that he only leased the property and did not feel he should be
obligated for future improvements to the property. Mayor Meyer asked why it
took Mr. Frey so long to file his appeal. Mr. Frey responded that he didn't
know he could file an appeal. Mr. Davis added he felt the requirements should
be met by the land owner and not the lessee. Mr. Lively added that citizens
in his ward were concerned with the condition of the property and stated that
screening with shrubs and .fence slats was reasonable and as much should be
done to shield the property from Main Street. Mrs. Rennie commented she
would like to see the matter continued to October 2, .1978, so the landlord could
be contacted. It was moved by Mr. Hulett, with a second from Mr. Adams, to ,

refer the matter to the staff and direct them to contact Senator Wingard, the /
owner, regarding the requirements for the conditional use permit and that '
the matter be continued to the next regular meeting, October 2, 1978. The
~otion passed unanimously.
3. Correspondence from Laurence E. Thorp - Appeal of Denial of Zone
Chanqe (R. Cochran & Hiatt). It was moved by Mr. Adams, with a second from
Mr. Lively, to accept the communication and set a pUblic hearing for October
9, 1978. The motion passed unanimously.
4. Appeal of Denial of Zone Chanqe for Property Located at 5271 Hiqh-
banks Road from RA Suburban District to M-2 Light Industrial District
(Sullivan). It was moved by Mr. Hulett, with a se~ond from Mr. Lively, to
accept the communication and set a hearing for October 9, 1978. The motion
