Thank you for your letter of February 15, 1979 regarding a Conditional Use
Permit on property owned by you at 3001 Hain Street in Springfield, Your
let,er was read to ,he Springfield Planning Commission at their February 21st
meeting.
The Planning Commission agreed to go along with your agreement to sign an
imp,'ovemen, agreement for sidewalks adjacent to rlain Street on the frontage'
of your property. The sidewalks could be built at the time sidewalks are
built along the neighboring property to the east. HO\;ever, .sidewalks must!
be instelled \;ithin 5 years in any ev'ent. SideHalks are to be in place ad--
jecent to :.lain Street by February 21; 1984.
The Planning Commission did insist that the street light agreement be signed

condition is a requirement. of the Conditional Use Permit ~Mr. Frederick
Frey has on your property, A copy of the CUP is enclosed for your information.

when the street lights will be installed, although it will be at least two

Linda Burns (Journal No. 5-77-86)
Located at 460 North 21st Street on the southwest corner of 21st and 'D' Streets
(Church of the Brethren). The CUP, which was granted on November 2, 1977, allows
the operation of a day care center in the R-l District. The CUP received a six
month extension on June 21, 1978 and is now due for consideration of another ex-
tension to allow the operation of the day care center to continue.
Linda Burns, 1826 'F' St., was present to represent this request and stated that
she wished to continue operating the day care center. Dick Johnson.said that he
wasn't aware of the status of the CUP but noted that the City had not received any
complaints from the neighbors. Mac Matsler reported that the building had been
inspected two weeks ago and was found to be in satisfactory condition. Dick Gassman
asked Ms. Burns if she operated a school on the property. Ms, Burns said yes. Mr.
Gassman asked if she planned to continue the operation. Ms. Burns said yes, but ex-
plained that another organization planned to use the center, too. She was in the
process of looking for another location for the day care center.
MOTION: It was moved by Dick Gassman and seconded by Mel Suit to grant a one year
extension, so that Linda Burns would be able to operate the day care center while
searching for another location.
The motion carried unanimously.
George Travess (Journal No. 5-77-12)

Located at 6364 Main Street on the north side of the street. between 60th and 66th
Streets. This property has a CUP which was approved on February 2, 1977 to allow
the construction of a church in the RA District. Construction is complete and the
Planning Commission may wish to remove all time limits from this CUP.
There was no one present to represent this request.
MOTION: It was moved by Mel Suit and seconded by Dick Gassman to remove all time
limits from the CUP. Chairman Adams asked Dick Johnson if all the requirements for
the CUP had been completed. Mr. Johnson said that the Building Division had reported
that construction and landscaping were completed.
The motion carried unanimously.
Frederick R. Frey (Journal No. S-77-76)
Located at 3001 Main Street, A CUP was granted October 5, 1977 to allow a towing and
auto service facility in the M-3 district. The towing and auto service facility is
operating and a slatted fence has finally been installed,; as required by the CUP,
However, the installation of sidewalks along-Main Street and the signing of a street
light agreement, both requirements of the CUP, have not been met and the owner of the
property has so far refused to meet these tHO conditions. The Planning-Commission
must now deal with this issue as the Staff, through repeated tries, has not been
able to gain compliance with the conditions of the CUP.

Joe Leahy reported that Dick Johnson had received information which may have obviated

the need for a public hearing at this time. Dick Johnson read the following letter
from George Wingard:
Thank you for your letTer of February 12, 1979 regarding the property on 3001
Main Street in Springfield. It is possible that . somewhere in the transferral
of conversations that some misunderstanding may have been formed. It is my rec-
ollection that I agreed to installing sidewalks adjacent to Main Street property
when sidewalks were installed upon the adjacent properties and I will agree to do
that. I don't believe I did agre~ to street light improvement contracts in my
conversation with the council members. I did not receive a copy of the improvement
agreement with your letter. I would appreciate you sending me one. I will sign
the sidewalk.improvement agreement when you send it. I appreciate your courtesy
in this matter. .
Mr. Johnson explained that some members of the City Council were up in Salem to meet
with a local delegate for various legislations. He understood that Mr. Wingard had
agreed to sign improvement agreements for street lights and sidewalks.

MOTION: It was moved by Dick Gassman and seconded by Sylvia Hoffman to direct the
Secretary to send another letter and copy of the conditional use permit conditions
to George Wingard. :bick Johnson is authorized to change the requirement from instal-
ling sidewalks to signing an improvement agreement for sidewalks along Main Street!
and that the .owner has a maximu~ time limit of five years to install sidewalks. Mr.
~ohnson is to point out to Mr. Wingard that it is necessary to sign an improvemerit
agreement for street lights, also. The mOTi?n also includes a 30 day-extension of
the conditional use permit so that Mr.l F~ey can continue his auto towing service./
The cUP is to be placed on the agenda for the second Planning Commission meeting in
March.
Chairman Adams asked Frederick Frey if he understood the motion. Mr. Frey said he
thought so, but complained that he had been receiving mail from the City at his
home address rather than 3001 Main St.
Chairman Adams pointed out that there seemed to be a problem with lessees and lessors
agreeing to conditions for CUP's. It puts lessees into a difficult situation. He'
suggested that the Planning Commission discuss the problem and perhaps agree to a
policy.
The motion carried unanimously.
2. SUBDIVISIONS
Jamie Plat
Located to the south and east of South 71st Street, on both sides of South 72nd St.,
abutting Thurston Hills Estates to the northeast, This property containing approx-
imately 2.88 acres would be divided into 10 lots. Preliminary approval.
Dick Johnson announced that this subdivision would be on the March 21st agenda, to
be discussed with the Thurston Hills Estates Subdivision. A number of concerns had
been unresolved at this point.
