George Wingard 2323 Fairmount Blvd. Eugene, OR' 97403 Dear MI'. Wingard: This will supplement my letter to you dated October 4, 1978, copy attached. In the second full paragraph from.the botto~on Page 1 of that letter, there is an error. The street light agreement, which must be signed within 30 days of the October 2nd City Council meeting, must be signed by the property owner. Therefore, in order to comply with the terms of the Conditional Use Permit which allow the auto towing service to continue on your property, the street light agreement must be executed by you. Execution of the street light agreement by your Lessee, Mr, Frederick Frey, is not acceptable. The agreement must be signed by the property owner. In the event that the City is unable to secure compliance with the conditions set forth in the Conditional Use Permit 'for the operation of the auto towing service by MI'. Frederick Frey on your property, the Conditional Use Permit will be revoked by the City of Springfield. In the case of such a revocation, the use of your property for an auto towing service by MI'. Frey will not be permitted. We request again that you contact this office at 726-3759 regarding these require- ments. We will be happy to answer any questions and discuss how you, as the property owner, and MI'. George Wingard 2323 Fairmount Boulevard Eugene, Oregon 97403 October 17, 1978 Mr. Richard Johnson Planning Department City of Springfield 126 North Fourth Springfield, Oregon Dear Mr. Johnson: Thank you for keeping us informed about the progress of meeting the ,:::0 requirements you have requested for the property located at 3001 Main Street. The request you have made for sidewalks aleng that property, I believe, is completely unreasonable. First of all, we would have the only sidewalk on that side of the street for a distance of thousands of feet in both directions. I would be happy to sign an agreement with you that would state that if all property owners along the street were required to put in sidewalks, I would be glad to do so at that time. To put a little section of sidewalk as an island between thousands of feet of unsidewalked area dees not seem to me to be a logical solution to the problem. I do not believe that it is reasonable to request a street lighting agreement to be signed as a conditional use ef this property. If the present tenant wishes to sign such an agreement that is fine with me, but I do not feel at liberty to encumber the property with such an agreement at this time.
