OREGON 97477 PLANNING DEPARTMENT October 4, 1978 126 NORTH FOURTH 726-3759 CERTIFIED LETTER - RETURN RECEIPT REQUESTED Mr.' George Wingard 2323 Fairmount Blvd. Eugene, OR 97403 Dear Mr. Wingard, On Monday, October 2, 1978 the Springfield City Council upheld the decision of the Springfield Planning. Commission to require that all conditions be met for the Conditional Use Permit (CUP) for Mr. Frederick Frey to operate an auto-towing service on your property, located at 3001 Main Street, For your information, the conditions of the CUP on your property, which must be met, are hereby listed; a. Off-street parking for customers must be provided on the property, with an oil mat. b. Installation of sidewalks along Main Street is required. Applicant has a time limit of one year to install the sidewalks. c. Installation of a slatted cyclone fence with shrubbery along Main Street, with fencing as required by ordinance along. the remainder of the property. Applicant must have this condition completed by the end of calendar year 1978. d. Signing of a street light agreement. Applicant has a period of 30 days to sign the agreement. . The Conditional Use Permit (CUP) to operate the auto-towing' service on your property was approved in October of 1977. Thus, a year has passed and none of the four conditions have been met. You, as the property owner, are therefore notified that these conditions must be met as stipulated, or the Conditional Use Permit 'will be revoked by the City of Springfield. Therefore, either you or your lessee will have to sign the street light agreement within 30 days of the October 2nd City Council meeting or the CUP will be revoked. One factor that must be emphasized in this whole matter is that the CUP applies to the property and not to a person; thus, even if the name of the operator or ownership of the property changes, the conditions will still have to be met for the present land use' to continue. \i ~~~".
