I agree that in general station facilities need not have a Public Way Use Agreement. However, this is a complex
project, so I want to make certain we are all on the same page rega4rding ROWand easement requirements.
Key items we identified during development.review :
. Additional ROW is needed to accommodate the widening of Gateway Street for EmX lanes. We. did not
want to have a continuous expanse of roadway with some portion of it outside of public ROW.
. It is OK for the sidewalk to be re-aligned to extend thr~ugh the station platform area, but a Public Sidewalk
Easement is needed to ensure continued public access for all users, not just station patrons.
. An Access and Maintenance Easement is needed to provide for city maintenance of traffic signal
equipment located outside the ROW.
All the above must come from Gateway Mall as the property owner.
Jon Driscoll is now reviewing the Final Site Plan for compliance with these conditions.

I was contacted by Charlie Simmons concerning a Public Way Use Agreement to cover L TD's use of public right
. of way for their Gateway Street EmX station.
In my opinion, this station is no different in principle than any other bus stop, even though its use of right of way
might be more extensive. While we might require a permit for L TD to establish a bus stop, as long as that facility
is within right of way, I would believe no additional agreement is necessary. This in contrast to a situation where
, L TD, or anyone else, sought to occupy property that the City owns in fee simple absolute. In that latter case, we
would be leasing real property and would need to have the formalities attending such a lease.
