Today I went over the MDS submittal requirements with Richard Hunsaker of the M&M Land Company. I gave
him 30 days from today to apply for an MD~, He indicated that he hoped he could have it in sooner than that.
After speaking with Jim, we determined that the application could be done as an MDS. I'll let you know when the
application comes in.

Bill,
This complaint came from another business owner directly to a planner while they were going through the
approval process. Mr. Hunsaker's property received site plan approval and as part of their application information
was provided by the City about the property being in a groundwater overlay protecting district that requires trash
receptacles areas to be piped and covered as well as fenced. On their site plan submittal, the applicant said they
were not going to have outside trash receptacles. .
I was referred this compliant from Planning and asked to send a Notice of Violation that required removal of the
trash receptacles and fencing because they don't comply with the groundwater protection area standards for
having outside trash receptacles. I was told they can apply for a modification of site plan and have outdoor
receptacles reviewed, but the existing location and method of fencing could not be approved as they exist. It took
me several weeks to track down Mr. Hunsaker by mail, as his tax records do not reflect his current address, so I
had to mail the information three times before it finally got to him. Thanks for directing him to Planning as that's
what the Notice he received does as well@.

Enforcement is, almost always, complaint driven. It may be possible for you to leam who complained, but often.
complaints are filed anonymously and we accept these: Other complainants ask that their names be protected in
confidence and, under certain criteria, this is allowed under Oregon Dept. of Justice guidelines. I'd guess the
letter you received is from Ms. Cindie Mott or Mr. David Bowlsby. They can address your request to learn the
name of the complainant.
More importantly, I'm sure Planning will work with you to see if there are ways to screen and secure your trash
collection area in compliance with the Development Code. .

Bill,
I received a certified letter from the City on Friday concerning a trash enclosure that was installed at the
building that Alan and I own located at the S.E.comer of Mohawk and Marcola Rd's.
After being open for over a year, trash from sources other than our tenants was becoming a real
problem.People were using our dumpster to dump their trash. To prevent this ,we authorized our
management company to hire a company to enclose the dumpster location with a site obscuring fence,
which is an apparent violation of City code. According to the letter I received a trash enclosure was
not required on our original building permit application, and that an approved enclosure must not be
visible from a City St.This would be next to impossible at our highly visible location.
Apparently this is a complaint driven letter.Is it possible to get a copy of the complaint?
Alan and I want to do what is reasonable to resolve this issue and would like your guidance.
How do we beSl'address this new issue?Thanks
