Leroy was informed on November 23, 2008 at 4:46 pm that the wall pack lighting fixtures must
contain full cut off shields prior to occupancy. When asked to install the cut off shields, he
deferred the answer to the owner and indicated the owner would be reluctant to comply with
that request. .
Occupancy was issued on Dec 2, despite the fact the cut off shields were still missing.
The proximity of the residential neighbors to the Sonic makes installation of the shields a
significant issue. .
Full cut off shields at this site are especially important due to the proximity of the residential
neighborhood. There are several single family dwellings adjacent to this site. Strict compliance
with SDC 4.5-110, which requires all outside lighting to be fully shielded, will reduce the impact
of the lighting on the residential neighbors, In addition to those conditions, the land use '
decision (DRC2008-00023) contains several conditions intended to mitigate the negative impacts
of the drive-thru restaurant on the residential neighbors.
Until the cutoff shields are installed, the Sonic is not u:. compliance with the development
agreement, signed August 15, 2008.
