Re: Your May 30 and June 9 emails regarding the Sonic/ Abby's.
Dear Mr. and Mrs. Fawbush,
Thank you for your emails reiterating your concerns, They are valid concerns that I, as the project
planner, had to balance with the rights of the development owner, While it is a basic premise of
compromise that no one gets everything they desire, I hope you take some comfort in the fact that )
your concerns were heard and applied to the criteria of approval.
Based on your comments, the developer was required to provide significantly more sound
attenuation than originally proposed, Your property is zoned Low Density Residenti8.I and the
adjacent property is zoned Major Retail Commercial, which is not an ideal situation for the
neighbors or for the restaurants. As home owners, you have the right to be free from
unreasonable intrusion of noise and lights, At the same time, the commercial land owners have a
right to deveiop the property in conformance with the development code, The city relies on the
neighbors to assist in identifying and resolving potential conflicts in these situations. Your
comments were instrumental in getting the upgraded fence and sound attenuation along the
property line, Once the restaurants are built, contact me if you experience noise, lights or other
intrusions from the Sonic/ Abby's development that are unnecessary or unreasonable, You have

It is important to note that the Sonic Drive-In and the Abby's Pizza must comply with the
conditions of approval in the staff report (DRC2008-00023) that was sent to you on May 29. If
you feel there is a violation of any of the conditions, or a violation of the Springfield
Development Code or Section 5,220 of the Springfield Municipal Code, you cm:t contact me
