Applications for Limited, Land Use Decisions require the notification of property owners/occupants 'within 300 feet of the subject property allowing for a 14 day comment period on the applications (SDC Sections 5.1-130 and 5.2-115). The applicant and parties submitting written comments during the notice period have appeal rights 'and are mailed a copy of this decision for consideration, . Notice was sent to adjacent property owners/occupants' within 300 feet of the subject site on March 26, 2008, . On April 8, 2008, the City's Development Review Committee reviewed the proposed plans. City staff's review comments have been reduced to findings and conditions only as necessary for compliance with the Tentative Site Plan. Criteria of Approval contained in SDC 5,17-125. This decision was issued on the 69th day of the 120 days mandated by the state, ' . In accordance With SDC 5.17-135, the Final Site Plan shall comply with the requirements of the SDC and the conditions imposed by the Director in this decision. The Final Plat otherwise shall be in substantial conformity with the tentative plan reviewed, Portions of the proposal approved as submitted during tentative review cannot be substantively changed during Final Plan approval, Comments Received: The applicant and parties submitting written comments during the notice period have appeal rights and are mailed a copy of this decision for consideration. See Appeals, on the last page of this report, Fred Fawbush, 2000 Scott Rd" submitted a packet of material on April 7, 2008, and sent an email on April 8, 2008, Robert Mer,cer, 2002 Scott Rd, submitted written comments on April 9, 2008. The full text of the comments from Mr. Fawbush and Mr, Mercer are made a part of this record by reference here and are available for review upon request. They had several concerns, Some of those concerns included noise, outdoor lights and access to their properties, proximity of , commercial uses to the residential neighborhood, length of the public comment period and dumpsters against the property line. Staff Response: Several issues were raised in the comments: 1. Proximity of commercial uses to dwellin\! and orouosed screenin\!, Originally, the applicant proposed a slatted chain lirik fence with plantings that will grow at least 4 feet high and cover the fence, This has been revised to an 8' high double-sided wood fence . with landscaping on the commercial side. 2, Lenlrth of uublic comment ueriod. The Springfield Development Code requires a 15 day comment period for a Type II application, The comment period started when the proposal was mailed on March 26 and it ended on A:pril 9, ' 3. Alterin\! site iJlan to relocate uarkin\! awav from conu:non urouertv line, The site is subject to a deed restriction (Inslrurr1.ent #7435618, recorded Aug 2, 1974) that requires certain areas of the site to be used for parking, circulation and buildings. These restrictions don't allow the site plan to be modified as Mr. Fawbush has requested. Sonic/Abby's Cose No. DRClOOB-00023 3 " i \ '4. Access to property to allow a future land division, The adjacent residential properties have frontage on Scott Rd. The proposed development will not alter that access. I;n addition, the commercial development will not alter or modify the existing access to any of the adjacent residential properties, The proposed development will not prevent division of the adjacent residential properties. ' SDC 5.17-125 Site Plan Review Criteria of Approval The Director shall approve or approve with conditions: a Type II Site Plan Review application upon determining that approv31 criteria A. through E" below have been satisfied, If conditions cannot be attached to satisfy the approval criteria, the Director shall deny the application. A, , The zoning is consistent with the Metro Plan diagram, and/or the applicable Refinement Plan diagram,Plan District map, and Conceptual Development Plan. Finding: The site is zoned MRC and the Metro Plan designates this property as Major Retail Commercial, It also designates the adjacent properties to the south as LDR (Low Density Residential) Zone and MDR (Medium Density Residential), The adjacent properties are zoned LDR and MDR Conclusion: The proposal complies with SDC 5.17-125(A), B., Capacity requirements of public and private facilities, including. but not limited to, water and electricity; sanitary sewer and stormwater management facilities; and streets and traffic safety controls shall not be exceeded and the public improvements shall be available to serve the site at the time of development, unless otherwise provided for by this Code and other applicable regulations. The Public Works Director or a utility provider shall deterniine capacity issues. SANITARY SEWER Finding: The applicant has proposed to connect to the existing 8" sanitary sewer line located along the south edge of the development, as shown on plan sheet CO,l, , Finding: Pursuant to Chapter 3,03.4,A of the City's Engineering Design Standards and Procedures }Allnual and Section 4.4 of Portland's Stormwater Management Manual, solid waste storage areas shall be covered and hydraulically isolated from potential stormwater runoff, and directed to the sanitary sewer system. The applicant has complied with this section of the qlde as shown on' plan sheet CO,l, STORMWATER MANAGEMENT Finding: To comply with SDC Sections 4.3-110.D & E, stormwater runoff from the site will be directed into several vegetative swales and filtered catch basins prior to discharge into the public system. The applicant proposes to maintain ,the existing connections to the public system as shown o~ sheet Cl.0. . WATEROUALITY Finding: The vegetation proposed for use in the vegetative swale will serve as the primary pollutant removal mechanism for the stormwater runoff, and will remove suspended solids and pollutants through the processes of sedimentation and filtration, Sonic/Abby's Case No. DRClOOB-00023 4 , Satisfactory pollutant removal will occur only when the vegetation has been fully established. Condition of Approval #1: The vel!etative swales shall be fullv vel!etated with all species established prior to issuance of the tentative occupancv buildinl! permit. Alternativelv, if this condition cannot be met. the applicant shall provide and maintain additional interim erosion control! water aualitv measures acceptable to the Public Works Department that will suffice until such time as the swale vee:etation becomes fully established, Conclusion: As conditioned, the proposal complies with SDC 5.17-125(B), C. The proposed development shall comply with all applicable public and private design and construction standards contained in this Code and other applicable regulations, Finding: The proximity of the commercial uses to the single family dwellings creates an inherent conflict. The drive in restaurant will generate sound, odors and lights that could negatively impact the adjacent residences, Because of this, the commercial development must provide more significant sound attenuation and visual barrier than required by the minimum standardsSDC 4,4-110. ' Finding: The fence was revised based on the drawing submitted on April 24, 2008, This drawing shows a solid 8' high double-sided wood fence with decorative wood post caps ' and a decorative rail cap and landscaping on the commercial side. Finding: The applicant submitted additional information regarding noise attenuating properties of the fence and proposed menu board speakers on May 21, 2008, Finding: the information submitted on May 21, 2008, indicates the noise absorbing qualities of the wood fence further reduces sound impacts to the adjacent properties, Condition of Approval #2: The final site plan shall be revised to show the revised fence, The,fence shall be constructed prior to anv occupancy. Finding: The noise analysis submitted indicates the noise levels will be further reduced by automatic volume controls and distance from the dwellings. The distance from the menu board speakers to the nearest residence is approximately 140 feet. Condition of Approval #3: The menu board speakers shall contain automatic volume control as described in the document submitted on Mav 21. ' Finding: The proposed fence (8' high, double sided, landscaping on commercial side) is adequate to block the light generated by the commercial development. All outdoor lighting must be fully shielded and directed downward to prevent light trespass onto the adjacent properties, In addition, all pole lights within 50' of the residential properties are limited to 12' high. Finding: The adjacent property owners requested access to their properties across the commercial property that will contain the Sonic and Abby's restaurants. Because those properties have frontage to ?cott Street, there is no regulation in,the Springfield Development Code that obligates Abre Polen LLC, the owner of the commercial property, to grant an easement for this purpose. It is also beyond the authority of the City of Springfield to compel such an easement because a nexus does not exist between the , Sonic/Abby's Case No. DRC200B-fl0023 5 , , requested exaction (the easement), the adopted Conceptual Local Street Plan, and the , impact of the commercial development. Conclusion: As conditioned, the proposal complies with SDC 5,17-125(C), D, . Parking areas and ingress-egress points have been designed to: facilitate vehicular traffic, bicycle and pedestrian safety to avoid congestion; provide connectivity within the development area and to adjacent residential areas, transit stops, neighborhood activitY centers, and commercial, industrial and public areas; minimize driveways on arterial and collector streets as specified in this Code or other applicable regulations and comply with the ODOT access management standards for State 'highways, , Finding: The circulation plan incorporates two points of access to Olympic ::;;,.~~~ and I provides access to the adjacent commercial properties to the east and west. Finding: The site is subject to a deed restriction (Instrument #7435618, recorded Aug 2, 1974) that requires parking, circulation and buildings to be located on specific areas of the site, The site plan complies with the deed restriction. This deed restriction prevents the site plan from being turned as requested by the neighbors, Conclusion: The proposal complies with SDC 5.17-125(D), E. Physical features, including, but not limited to: steep slopes with unstable soil or geologic conditions; areas ,with susceptibility of flooding; significant clusters of trees and shrubs; watercourses shown on the WQL W Map and their associated riparian areas; wetlands; rock out~.ut't':ngs; open spaces; and areas of historic and/or archaeological significance, as may be specified in Section 3.3-900 or ORS 97.740-760, 358.905-955 and 390,235-240, shall be protected as specified in this Code or in State or Federal law. Finding: The site is within the 1-5 year TOTZ. Because of this, SUB has requested wellhead protection signs be. placed at each of the trash enclosures and at the north end of the parking lot. Condition of Approval #4: Prior to occupancy. place wellhead protection signs at each of the trash enclosures and at the north end of the parking lot. Finding: A DWP application or an approved exemption is required prior to final site plan approval, The exemption must comply with the standards contained in SDC 3.3-230. Condition of Approval #5: Prior to approval of the final site plan. submit a DWP apolication or request for exemption. The application or exemption must be approved prior to approval of the final site plan, Conclusion: As conditioned, the proposed tree felling complies with SDC 5.17-125(E), DETERMINATION: Based on the evidence in the record, the Director determines the site plan complies with SDC 5.17-125IAI-IEl. subiect to the Conditions of Aooroval attached to this report. The Final Site Plan submittal shall incorporate all approval conditions listed in the staff report, The Final Site Plan shall become null and void if construction has not begun within two years of the signing of the Development Agreement required in Section 5,17-140," A Final Site Plan application is charged upon submittal of the complete application and all required documents and after all conditions of approval are met, including the construction of public and private improvements and extension of utilities required through this decision. The Final Site Plan shall comply with the requirements of the SDC and the conditions imposed by the Director in this deciSion. The Final Site Plan otherwise shall be in substantial conformity with the tentative plan reviewed. Portions of the proposal 'approved as submitted during tentative review cannot be substantively changed during final site plan approval. MENT OF L~OR (OSHA) OSHA is an' agency of the federal government that is concerned with the working conditions of the employee. It hss the power to legis- late and enforce laws where the physical, mental and environmental safety of tbe employee is concerned. 4. Local communities have the power to set up a Evironmental Control , Agency. This agency can modify the rules and regulations set by the (EPA) to suit their own particular circumstances. The agency may be controlled by the building department. bealth department or a separate agency by itself. EXAMPLE: In Chicago it is. the Department of Environmental Control. In small c9mmunities tbe state may assume the responsibility. It would be well worth the effort to check your local area for an agency that 1. responsible for noise control. MEASURING SOUND: Measuring sound ,means that we use a small range of numbers to measure a "ide range of sounds. As ODe expert put it: "The total range of sound levels from threshold of hearing to the threshold of pain (0 to 140 dBA) represents a sound pressure. range of (1 to 10,000,000)1" For example: Ordinary. speech is measured at 60 decibels, street traffic at 70. But street traffic isnot ten percent, louder than speech, it is ten time,! louder. . A small change in de::ibel value then can mean a tremendous change in the intensity of the noise. In general, any improvement thet causes' even a small decrease in decible level is significant. A drop of three decibels means the noise level has been cut in half. -, I.Z of 1'1 OUESTIONS ABOUT NOISE.: \ At,what point does sound become noise? .J As oUT definition states, s9und becomes noise when it is unwanted. At what point does this change take place? Every person is different. What is sound to one person could be noise to another. This is where the drive-thru can get into trouble. If a neighbor living adjacent to a McDonald's property becomes irritated with the sounds, whether they are horns blowing, loud mufflers or the drive-thru intercom speaker, to the neighbor the unwanted sound is noise. He cpuld notify the local Department of Environmeotal Control and register his complaint, A representative will be sent out with.monitor- ing equipment to check the sound levels at the property line. If the sound levels are above what the local codes permit, the store could be .. issued a citation'. Whether it' 5 the restaurant. Each city, town or village can be different. Whether the area is . residential or industrial can make a difference also. With the outbound volume control set at mid range; check readings to correspond to chart in question (1). .' If no meter is available. set outbound control as described and have SOQeone talk in a normal manner and check the voice to that of someone standing one (1) foot from you talking in a normal manner. then measure the distance from the menu board or speaker post ,to t.he property line and check distance with chan in question. A sound retaining wa,ll or baffle might be the only anSlo/er, some- thing that will break up th~ sound or absorb it. SOUND IN .THE DRIVE-THRU BOOTH: The National Sanitation Foundation (N,S.F.) and local health depart- ments areorgani~ations that protect the public's health in regards to the way food is prepared and the equipment and area around said equipment are maintained and cleaned. In the McDonald's store ye have the highest standard of sanitation of any restaurant and have a world-wide reputation of cleanliness. What this means is that we spend' a lot of time 'finding the right way to do the job better than anyone else. All of the equipment is made of stainless steel, the floors and walls are covered with ceramic tile, the ceilings are made of Marlite, dry wallar drop-in acoustical t.iles. We maintain large glass windolo/ areas supported by aluminum mullions, and we put the drive-thru operation of our business in a booth 'of approximately 311 'ft3 in size. Every surface except for the acoustical drop-in ceiling tiles does not absorb, but reflect sounds, and the sound levels within the booth during peak hours can get as high as 85 to 90 dB. ., OSHA has set some permissible noise exposure guide-lines. .'
